3327 E SOLUTION NO. 3 ,327 A RESOLUTION REQUESTING CONSIDERATION BY THE HOUSING AND HOME FINANCE AGENCY OF THE TERMINATION OF A CERTAIN AGREEMENT DATED MARCH 20, 1946, FOR IMPROVEMENTS TO THE MUNICIPAL AIRPORT; AND FOR OTHER PURPOSES. WHEREAS, the United States of America has heretofore made an advance, pursuant to an agreement dated March 20, 1946, to the City of Little Rock in the amount of Thirty-Three Thousand Eight Hundred Thirty-Four and No/100 Dollars ($33,634.00) for the purpose of plan preparation of the public work described in the agreement as a "Plan Preparation for Construction of Certain Public Work;" and WHEREAS, by the use of the Federal advance, the City of Little Rock caused to be prepared plans and specifications for the public work described in theaforesaid agreement; and WHEREAS, no construction has been undertaken of the project or any portion thereof described in the aforesaid agreement dated as of the 20th day of March, 1946; and WHE.ZEAS, there is no reasonable liklihood of the planned project or any portion thereof being undertaken because: A. During the period after acceptance on July 11, 1949, a transition in the method of airport operation occurred resulting in the creation in 1951 of The Little Zock Municipal Airport Commission. During this period, the public work described in the agree- ment lay dormant. B. A necessary period of time for organization was required by the Airport Commission, during which time no implementation of the plan occurred. C. During this intervening time, the State of the Art in Aviation and Airport Science progressed in such a manner as to render these plans and specifications for public work impractical. D. Acting upon recommendations of the Federal Aviation Agency, a new Master Plan was developed, incorporating more advanced ideas and Technology. Upon acceptance by the Airport Commission, all prior plans were superseded. -2- NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. There being no reasonable liklihood of the aforesaid project or the plans and agreement dated March 20, 1946, between the City of Little Rock and the United States of America acting by and through the Housing and Home Finance Agency ever being implemented or placed under construction for the reason set forth above, the housing and Home Finance Administrator is hereby requested to make a determination that the agreement dated March 20, 1946, for airport construc- tion and improvement be terminated and that the City of Little Rock be relieved of all liability thereunder and that the plans and projects originally contemplated thereunder be canceled and set aside for any and all purposes.
