3290 RESOLUTION NO. 3,290 A RESOLUTION RATIFYING, APPROVING AND CONFIRMING THE PURCHASE BY THE CITY OF LITTLE ROCK OF RIGHT-OF-WAY AT THE INTERSECTION OF UNIVERSITY AVENUE AND MARKHAM STREET ; RATIFYING AND CON- FIRMING PAYMENT THEREFOR; AND FOR OTHER PURPOSES. WHEREAS the City of Little Rock has heretofore consummated a transaction with St. Vincent ' s Infirmary, wherein and whereby the City of Little Rock acquired an additional ten-foot (10-foot) right-of-way from the Southeast intersection of Markham Street and University Avenue Eastward for a distance along the South right-of- way line of West Markham Street and did pay for said right-of-way the sum of Eight Thousand and No/100 Dollars ($8,000.00) ; and WHEREAS, said right-of-way is necessary and essential in the widening and improving of the intersection of West Markham Street and University Avenue; and WHEREAS it is the desire of the Board of Directors to ratify, confirm and approve the transaction in its entirety; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS : SECTION 1. A warranty deed conveying to the City of Little Rock, Arkansas, from St. Vincent' s Infirmary certain property des- cribed in Section 2 hereof, which deed is dated February 3, 1965, and is recorded in Deed Book 905, page 563, of the Deed Records of the Circuit Clerk and ex officio recorder of Pulaski County, Arkansas, is hereby accepted by the City of Little Rock. The pay- ment by the City Manager and Director of Finance of Eight Thousand and No/100 Dollars ($8,000.00) as consideration for the aforesaid conveyance, which payment was made on February 3, 1965, is hereby ratified, confirmed and approved. The acceptance of the deed and the payment of the aforesaid sum in consideration thereof is by this resolution fully ratified, confirmed and approved as though same were authorized in advance by this Board of Directors. SECTION 2. The deed referred to in Section 1 hereof is in form and substance as follows : WARRANTY DEED KNOW ALL MEN BY THESE PRESENTS: THAT St. Vincent Infirmary, a charitable institution, acting by and through its authorized and qualified Officers, for and in consider- ation of the sum of Eight Thousand and No/100 Dollars ($8,000.00) in hand, paid by the City of Little Rock, Arkansas, GRANTEE, the receipt of which is hereby acknowledged, does hereby grant, bargain, sell and convey unto the said GRANTEE and unto its successors and assigns for- ever the following lands lying in the County of Pulaski and State of Arkansas, to-wit: The North twenty-five (25) feet of the West three hundred fifty (350) feet of Lot twelve (12) of Howard Adams and R. D. Plunkett 's Subdivision of the West one-half (W1/2) of the Northwest one-quarter (NWg) of Section six (6) , Township one North (T-1-N) , Range twelve West (R-12-W) , and, beginning at a point which is fifty-five (55) feet South of and twenty-nine (29) feet East of the Northwest corner of said Lot twelve (12) of Howard Adams and R. D. Plunkett's Subdivision of the West one-half (W1/2) of the Northwest one-quarter (NW4) of Section six (6) , Township one North (T-1-N) , Range twelve West (R-12-W) ; thence in an Easterly direction along the arc of a circular curve having a radius of thirty (30) feet to a point which is twenty-five (25) feet South of the North line of said Lot twelve (12) and fifty-nine (59) feet east of the West line of said Lot twelve (12) ; thence Westerly along a line that is parallel to and twenty-five (25) feet South of the North line of said Lot twelve (12), thirty (30) feet to a point; thence Southerly parallel to and twenty-nine (29) feet East of the West line of said Lot twelve (12), thirty (30) feet to the point of beginning. To have and to hold the same unto the said GRANTEE and unto its successors and assigns forever, with all the appurtenances thereto belonging. GRANTOR does hereby covenant with GRANTEE that it will warrant and defend the title to the said lands against all claims whatever. IN WITNESS WHEREOF, the GRANTOR, St. Vincent Infirmary, does here- unto cause to be affixed the hand of its Administrator and Secretary, respectively, on this day of February, 1965. COUNTY OF PULASKI) On this day of February, 1965, before me, a notary public duly commissioned, qualified and acting within and for the said County and State, appeared in person the within named Sister Thomas de Sales Bailey and Sister Margaret Louise Dalton, being the Administrator and Secretary, respectively, of the St. Vincent Infirmary, a charitable institution, and who had been designated by said charitable institution to execute the above instrument, to me personally well known, who stated that they were the Administrator and Secretary of said in- stitution and were duly authorized in their respective capacities to execute the foregoing instrument for and in the name and behalf of said charitable institution, and further stated and acknowledged that they had so signed, executed, and delivered said foregoing instrument for the consideration, uses and purposes therein mentioned and set forth.
