3265 _ RESOLUTION NO. 3, 265 A RESOLUTION APPOINTING GARVER & GARVER, INC. , ENGINEERS, TO PREPARE CERTAIN PLANS AND PROPOSALS AND PERFORM OTHER SERVICES FOR THE IMPROVEMENT OF THE THIRD STREET VIADUCT; ESTABLISHING A BASIS OF COMPENSATION FOR THE WORK; AND FOR OTHER PURPOSES. WHEREAS it has been determined that repairs and improvements are urgently needed for the Third Street Viaduct in the City of Little Rock and that detailed plans and specifications and work programming are needed in order to properly pursue the said repairs and improvements ; and WHEREAS the City of Little Rock desires to constitute and appoint Garver & Garver, Inc. , as its engineers for the several purposes herein contained and to provide compensation for the said engineering firm in connection with the said work; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS : SECTION 1. The architectual firm of Garver & Garver, Inc. , of Little Rock, Arkansas, is hereby constituted and appointed as engineers for the City of Little Rock to prepare necessary plans, specifications and other pertinent documents for the rehabilita- tion and repairing of the Third Street Viaduct in the City of Little Rock as more specifically set forth in Section 2 hereof. SECTION 2. The scope of work to be performed by the said engineers referred to in Section 1 hereof shall be the establish- ment and programming of necessary repairs, establishment of priorities among the several programmed items, establishment of alternate methods and costs and feasibility estimates for the accomplishment of the repairs and rehabilitation under vehicular and railroad traffic conditions and a program of stage construction with costs estimates pertaining thereto. The items of repairs and rehabilitation to be considered and treated in the above work shall -2- include structural strengthening of the viaduct, widening of the surface and walkways on the viaduct, installing handrailing and street lighting and the replacement or renovation of drainage and expansion devices, methods and materials used in repair and renovation and necessary traffic maintenance during the accomplish- ment of the repairs and renovation. SECTION 3. Upon accomplishing the foregoing, the engineers shall prepare contract drawings, specifications and bidding docu- ments when and as necessary. SECTION 4. Said architectual firm shall receive as its com- pensation for the work outlined in Section 2 its "out-of-pocket" salary costs attributable to the work increased by multiple of two (2) , providing, however, that the said fee shall not exceed the sum of Four Thousand and No/100 Dollars ($4,000. 00) . The architect shall bill the City monthly with a detail of the time for which billing is made until the work shall have been completed or the aggregate of billing to the City shall equal Four Thousand and No/100 Dollars ($4,000.00) , whichever shall first occur. The City shall be entitled to audit the records of the architect at any reasonable time. The fee to which the architect shall be entitled for the preparation of contract drawings, specifications and bidding documents under Section 3, when and as needed and directed by the City, shall be based upon the construction costs as follows : Construction Costs Architect Fee Less than $50,000.00 7k% $50, 000. 00 to $100,000.00 627 $100,000.00 to $200,000.00 6% The architect shall, when and as directed by the City, furnish resident technical inspection and supervision of construction for a compensation equal to its "out-of-pocket" salaries for the time -3- consumed for the supervision as increased by a multiplier of one and one-half (11/2) .
