A RESOLUTION AWARDING A CONTRACT FOR THE
PURCHASE OF A TRUCK-MOUNTED STRIPING
MACHINE TO RUSHING AND MASON EQUIPMENT
CO. , INC. : AND FOR OTHER PURPOSES.
WHEREAS, pursuant to advertisements for bids according
to specifications for a truck-mounted striping machine, bids
were taken and opened pursuant to law; and
WHEREAS, the lowest bid was made by Rushing and Mason
Equipment Company, Inc . , in the sum of Twenty Seven Thousand
Nineteen and 30/100 Dollars ($27,019 .30) ; and
WHEREAS, it appears that the product bid by Rushing and
Mason Equipment Company may not conform to the specifications
and may not be the quality product sought by the City of Little
Rock; and
WHEREAS, it is the desire of the Board of Directors that
the bid of Rushing and Mason Equipment Company, Inc . , be
accepted and a contract awarded therefor, subject to certain
conditions;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:,
SECTION 1. The low bid of Rushing and Mason Equipment
Company, Inc. , in the sum of Twenty Seven Thousand Nineteen
and 30/100 Dollars ($27,019 .30) for a truck-mounted striping
machine is hereby accepted, subjectto the conditions set forth
in Section 2.
SECTION 2. The City Manager is hereby directed and
authorized to place into service the equipment bid by the said
successful bidder for a trial of ninety (90) days, at the end
of which time the City Manager shall determine if said equip-
ment wholly and fully complies with the specifications and
whether or not the said item of equipment is serviceable and
reasonably free of mechanical defects and that adequate service

and warranty as to replacement parts and labor is available
from the bidder to insure the usefulness of said equipment
to this City. If, at the end of ninety (90) days , the City
Manager shall determine that the above conditions have been
met, the City Manager and Director of Finance are authorized
to issue the warrant or warrants of this City in payment of
the said equipment. If such conditions shall not have been
met in the judgment of the City Manager, the equipment bid
by Rushing and Mason Equipment Company, Inc . , shall be re-
turned to the bidder, free of any obligation on the part of
the City of any type whatsoever.
SECTION 3 . This resolution shall be in full force and
effect from and after its adoption.
