3150 F w RESOLUTION NO. 3, 150 A RESOLUTION ACCEPTING THE LOW BID OF BEMBE:RG IRON WORKS IN THE SUM OF FOUR THOUSAND FIFTY AND 75/100 DOLLARS ($4,050.75) FOR THE CONSTRUCTION OF A NEW ROOF ON LION CAGES IN WAR MEMORIAL PARK; AUTHORIZING A CONTRACT THEREFOR; AND FOR OTHER PURPOSES. WHEREAS, Pursuant to advertisement and invitation, bids were taken and opened on April 13, 1964, for the construction of a new roof for lion cages in War Memorial Park of the city of Little Rock; and WHEREAS, Bemberg Zorn Works was the lowest responsible and responsive bidder for said work in the sum of Four Thousand Fifty and 75/100 Dollars ($4,050.75) ; and WHEREAS, It is the desire of the City of Little Rock to award a contract for the construction of a new roof for lion cages as aforesaid to the said lowest responsive and responsible bidder; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS : SECTION 1. The bid of Bemberg Iron Works in the sum of Four Thousand Fifty and 75/100 Dollars ($4,050.75) for the construction of a new roof on the lion cages in War Memorial Park, pursuant to the specifications set forth in the bid proposal and according to the terms and conditions of the bid documents, is hereby accepted. SECTION 2. The Mayor and City Clerk are hereby authorized and directed to execute for and in behalf of the City a contract with Bemberg Iron Works in form and substance, as follows: C O N T R A C T This contract and agreement made and entered into this day of , 1964, by and between Bemberg Iron Works, Little Rock, Arkansas, hereinafter referred to as CONTRACTOR and the City of Little Rock hereinafter referred to as CITY, WITNESSETH: That for and in consideration of the payment to be made as hereinafter set forth the CONTRACTOR agrees to furnish all tools, equipment and labor to complete the installation of the metal roof cages and all iron and other materials required as shown on the plans and drawings entitled, "New Roof for Lion Cages, Little Rock City Zoo", dated March 27, 1964, which plans and specifications are incorporated herein by reference as though set forth word for word and paragraph for paragraph in which drawings and specifications are on file in the Depart- ment of Parks and Recreation, City Hall, Little Rock, Arkansas. All materials called for in the said plans and specifications shall be new and perfect materials. It is agreed and understood between the parties hereto that the CONTRACTOR will accept and the CITY will pay for the work herein called for the sum of Four Thousand Fifty and 75/100 Dollars ($4,050. 75) to be paid upon the completion of the said work to the entire satisfaction of the Director of Parks and Recreation of the CITY. CONTRACTOR agrees to maintain at all times during the life of this contract public liability and property damage insurance and workmen's compensation insurance and to furnish evidence of such insurance to the CITY prior to the commencement of the work called for herein and further to save and hold harmless the CITY from all claims whatsoever arising in connection with the performance of the contract by the CONTRACTOR. CONTRACT - Page Two CONTRACTOR further agrees to complete within Ninety (90) calendar days following the date of the signing of this contract. CONTRACTOR agrees to secure all permits which may be required by the City of Little Rock for the performance of the work called for in this contract, the fees in connection with which will be waived by the CITY, and will comply with such proofs of the Ordinances of this CITY where same are applicable with the work. CITY reserves the right to alter, change or modify the specifications at any time prior to completion of the work and, upon such change, alteration or modification, the contract price shall be likewise changed, altered or modified in a fair and equitable manner according to the quantities and scope of work so affected.
