3106 1 RESOLUTION NO. 3:106 A RESOLUTION GRANTING A FRANCHISE TO NATIONAL INVESTORS LIFE INSURANCE COMPANY TO CONSTRUCT IMPROVEMENTS WITHIN CERTAIN PUBLIC RIGHT-OF-WAY; AND FOR OTHER PURPOSES . BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS : SECTION 1. A right, privilege and franchise is hereby granted to National Investors Life Insurance Company for the con- struction of certain improvements within public right-of-way, as more specifically described in Section 2 hereof, which improvements shall consist of a six inch (6") encroachment in the form of lime- stone and brick walls below the nine foot (9 ' ) level and the in- stallation of curbing within the public right-of-way as described in section 2 hereof. SECTION 2. The public right-of-way made subject to the with- in franchise is and shall be described as follows : Beginning at the Northeast corner of Lot 1, Block 102, Original City of Little Rock, Arkansas , thence East 2 feet to a point; thence South 150 feet to a point; thence West 2 feet to the Southeast corner of Lot 3 , Block 102, Original City of Little Rock; thence North 150 feet to the point of beginning. SECTION 3 . The City of Little Rock retains the right to re- voke this franchise at any time said right-of-way is needed for public purposes and the said National Investors Life Insurance Company or assigns shall be required to remove all improvements thereon and shall be required to pay all costs attendant with the removal of the said improvements from said public right-of-way. As a condition upon the granting and continuance hereof, Fran- chisee, its successors and assigns, shall maintain the aforesaid right- of-way clear and free of debris, litter or trash at all times, and will save and hold harmless the City of Little Rock, its agents or employees from any and all liability whatsoever arising from the construction or existence, or both, of any improvements within the aforedescribed 0 AL -2- right-of-way.
