3065 RESOLUTION NO. 3 ,065 A RESOLUTION ACCEPTING THE LOW BID OF MEDLIN PLUMBING & HEATING COMPANY IN THE AMOUNT OF THREE THOUSAND THREE HUNDRED ONE AND 17/100 DOLLARS ($3,301.17) FOR REPAIRS TO HEATING SYSTEM AT CENTRAL FIRE STATION IN LITTLE ROCK, ARKANSAS; AUTHORIZING THE EXECUTION OF A CONTRACT FOR SAID REPAIRS; AUTHORIZING PAYMENT THEREFOR; AND FOR OTHER PURPOSES . WHEREAS, invitation for bids for the repairing of the Heating System at Central Fire Station in Little Rock have been legally pub- lished; and WHEREAS , bids have been received and opened pursuant to said invitation; and WHEREAS, the bid of Medlin Plumbing & Heating Company is the lowest responsible and responsive bid submitted therefor; and WHEREAS, the City of Little Rock desires to award a contract for the said repairs to the said Medlin Plumbing & Heating Company; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The low bid of Medlin Plumbing & Heating Company in the amount of Three Thousand Three Hundred One and 17/100 Dollars ($3,301.17) for the repairing of the Heating System at Central Fire Station in Little Rock is hereby accepted. SECTION 2. The Mayor and City Clerk are hereby authorized and directed to execute on behalf of the City of Little Rock a con- tract with Medlin Plumbing & Heating Company for the said repairs, which Contract shall be in form and substance as follows : C O N T R A C T THIS CONTRACT AND AGREEMENT made and entered into this day of , 1963, by and between MEDLIN PLUMBING & HEATING COMPANY, hereinafter referred to as CONTRACTOR, and the CITY OF LITTLE ROCK, ARKANSAS, hereinafter referred to as CITY, WITNESSETH: For and in consideration of the payment to be made as hereinafter set forth, CONTRACTOR agrees to furnish all tools, equipment, materials and labor to repair the Heating System at Central Fire Station in the City of Little Rock, Arkansas, in exact and complete accordance with the Bid Proposal for the work prepared by the Department of Public Works and on file in the Department of Public Works of the City of Little Rock, Arkansas, and pursuant to which CONTRACTOR has bid at the price hereinafter indicated, which Bid Proposal is attached hereto and made a part hereof as though copied in full herein, and to perform the work called for under the direct supervision and to the entire satis- faction of CITY. It is agreed and understood between the Parties hereto that CONTRACTOR will accept and CITY will pay for the work the sum of Three Thousand Three Hundred One and 17/100 Dollars ($3,301 . 17) , which sum shall be paid in full within seven (7) days following completion of the work and acceptance thereof by CITY. CONTRACTOR further agrees to furnish to CITY a performance bond and to maintain at all times during the work public liability insurance, workmen' s compensation insurance and to save and hold harmless the CITY from any and all claims whatsoever arising out of or in connection with the work. CONTRACTOR further agrees to begin work within forty-eight (48) hours after the issuance of a work order by CITY and to complete the work on or before October 15, 1963. -2- CITY reserves the right to alter, change or modify the scope of the work at any time prior to completion thereof and, upon such change, alter or modification, the contract price shall be likewise changed, altered or modified in a fair and equitable manner according to the quantities and scope of work affected.
