A RESOLUTION ACCEPTING THE LOW BID OF WESTERN WATERPROOFING
COMPANY IN THE AMOUNT OF NINE THOUSAND NINE HUNDRED AND NO/100
DOLLARS ($9 ,900.00) FOR WATERPROOFING CITY HALL; AUTHORIZING
THE EXECUTION OF A CONTRACT FOR SAID PROJECT; AND FOR OTHER
PURPOSES .
WHEREAS, invitation for bids for the waterproofing of certain
exterior walls of City Hall in the City of Little Rock have been legally
published; and
WHEREAS, bids have been received and opened pursuant to said
invitation; and
WHEREAS, the bid of Western Waterproofing Company is the lowest
responsible and responsive bid submitted therefor; and
WHEREAS, the City of Little Rock desires to award a contract
for the said project to the said Western Waterproofing Company;
NOW THEREFORE, BE IT RESOLVED BY THE BOA RD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The low bid of Western Waterproofing Company in the
amount of Nine Thousand Nine Hundred and No/100 Dollars ($9 ,900 .00)
for the waterproofing of certain exterior walls of City Hall in the
City of Little Rock is hereby accepted.
SECTION 2. The Mayor and City Clerk are hereby authorized and
directed to enter into and execute on behalf of the City of Little
Rock a contract with Western Waterproofing Company for the said project,
which Contract shall be in form and substance as follows :
C O N T R A C T
THIS CONTRACT AND AGREEMENT made and entered into this _
day of June, 1963 , by and between Western Waterproofing Company, here-
inafter referred to as CONTRACTOR, and the City of Little Rock, Ark-
ansas, hereinafter referred to as CITY, WITNESSETH:
I/
That for and in consideration of the payment to be made as
hereinafter set forth, CONTRACTOR agrees to furnish all tools , equipment,
materials and labor to waterproof certain exterior walls of City Hall
in the City of Little Rock, Arkansas, in exact and complete accordance
with the specifications for the work prepared by Jan Carter, City Engi-
neer, and on file in the Department of Public Works of the City of Little
Rock, and pursuant to which CONTRACTOR has bid at the price hereafter
ndicated, which plans and specifications and bid are attached hereto
and made a part hereof as though copied in full herein , and to perform
the work called for under the direct supervision and to the entire satis-
faction of CITY.
It is agreed and understood between the Parties hereto that CON-
TRACTOR agrees to accept and CITY agrees to pay for the work the sum
of Nine Thousand Nine Hundred and No/100 Dollars ($9 ,900 .00) , which
sum shall be payable in full upon completion of the work and acceptance
thereof by CITY . Upon completion of the work CONTRACTOR shall satisfy
CITY that all labor and materials used on the job have been paid for
and shall otherwise satisfy CITY that the conditions and all requirements
made in the specifications have been met ; following which, within seven
(7) days , the full contract price shall be paid to C0NTRACTOR.
CONTRACTOR agrees for the consideration above stated to begin work
within one (1) week after being ordered to begin work by CITY and to
complete the work within thirty (30) calendar days from the date of said
order.
CITY reserves the right to alter, change or modify the specifica-
tions at any time prior to completion of the work and, upon such change,

alteration or modification, the contract price shall be likewise
altered, modified or changed in a fair and equitable manner ac-
cording to the quantities and scope of work affected.

SECTION 3 . The City Manager and Director of Finance are hereby
authorized and directed to execute the necessary warrant in payment
of the bid price herein.
SECTION 4. This resolution shall be in full force and effect
from and after its adoption.
