A RESOLUTION AUTHORIZING THE SALE OF HOUSES AND IM-
PROVEMENTS LOCATED UPON RIGHT-OF-WAY PROPERTY ACQUIRED
BY THE CITY OF LITTLE ROCK FOR THE EAST-WEST EXPRESSWAY;
PROVIDING FOR THE FORM OF CONTRACT FOR THE SALE OF SAID
HOUSES AND IMPROVEMENTS; AUTHORIZING EXECUTION OF CON-
TRACTS PURSUANT TO BIDS; AND FOR OTHER PURPOSES .
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, shall, where
feasible, let bids for the sale of all houses and improvements lo-
cated in, about or upon right-of-way property acquired by the City
of Little Rock for use in the East-West Expressway. The City shall
accept the highest bid and shall contract with the bidder according
to the terms of a written contract more specifically set forth in
Section 2 hereof.
SECTION 2. The form and substance of the written contract
to be executed pursuant to bids shall be as follows:
C O N T R A C T
THIS CONTRACT, entered into on this day of
19 , by and between the City of Little Rock, Arkansas, hereinafter
called SELLER and of
hereinafter called BUYER,
WITNESSETH:
1. SELLER hereby sells to BUYER and BUYER hereby purchases from
SELLER all structures and improvements on lands designated as Parcel
Number , located at
Street in the East-West Expressway project in the City of Little Rock,
Arkansas, for the sum of
($ ) , the receipt of which sum is hereby acknowledged by the
SELLER.
2. BUYER agrees to remove all of said structures and improve-
ments from said premises, under conditions hereinafter set forth, at
BUYER'S sole expense, within days from this date, and shall
hold SELLER and any or all other persons free from harm and any damages
whatsoever, caused by action of BUYER or his agents .
3. BUYER agrees:
(a) To completely dismatle and/or remove all of said structures
and improvements from their present location.
(b) That all material anddebris from said structures, or found
on the parcel such as trash, fences, and outbuildings shall be removed
from the parcel to ground level.
(c) To obtain any and all permits required by the City of Little
Rock, Arkansas.
(d) To cap all utilities and sewer outlets in a safe and work-
manlike manner at the time the structures are removed. In the event
any utility service lines to other buildings or premises are discon-
nected, destroyed or otherwise impaired, in any way by reason of the
removal or dismantling of said improvements the BUYER, at his own ex-
pense, shall provide to such building or premises adequate substitute
utility service lines in lieu of those affected.
(e) To construct adequate temporary barricade fences around
the basement of any building removed or dismatled and around any other
excavation on said property for the purpose of protecting pedestrians
or animals from falling into such basement or excavation.
4. At the time of execution of this Contract, BUYER has de-
posited with SELLER the sum of $ , as a guarantee, that
BUYER shall leave said premises free of all debris from said structures
after they have been wrecked and free of all fences, outbuildings, and
ordinary trash. In the event the BUYER fails to remove said structures
and improvements and clean up said premises to the satisfaction of
SELLER, said deposit shall be retained by SELLER; otherwise, it shall
be returned to the BUYER. Time is of essence in this contract and in
the event BUYER fails to perform and complete all work stipulated herein

within the time set forth above, SELLER shall retain both purchase price
and deposit.
S. It is specifically agreed by and between SELLER and BUYER
that SELLER shall not have any right of supervision or control over the
methods and means employed by BUYER in carrying out BUYER'S obligations
under this contract.

SECTION 3 . The Mayor and City Clerk are hereby authorized
and directed to execute for and in behalf of the City of Little
Rock a formal contract, as contained in Section 2 hereof, when
completed with all of the particulars established in the bidding
without any further approval of this Board of Directors, provided
that the Contract is between the City of Little Rock and the
highest apparent bidder for the tract described in the Contract.
SECTION 4. This resolution shall be in full force and ef-
fect from and after its adoption .
