3003 RESOLUTION NO. 3,003 A RESOLUTION AWARDING A CONSTRUCTION CONTRACT FOR THE CONSTRUCTION OF THE DOWSMITH INC. INDUSTRIAL PROJECT WHEREAS, after due advertisement as provided by law, bids were received on May 1, 1963 for the construction of the DowSmith Inc . industrial plant being financed by City of Little Rock, Arkansas (herein called "City") Industrial Development Revenue Bonds dated May 1, 1963; and WHEREAS, the low bid was submitted by N. P. Alessi, Inc . and the next low bid was submitted by Pickens-Bond Construction Company; and WHEREAS, the said two low bidders have been investigated in order to arrive at a determination of the lowest responsible bidder for this particular industrial plant; and WHEREAS, the City has entered into a Lease and Agreement with DowSmith Inc . which, among other things , requires the approval of DowSmith Inc. of the contractor to whom the Construction Con- tract is to be awarded; and WHEREAS, DowSmith Inc. has advised the City by letter attached hereto and made a part hereof that N. P. Alessi, Inc . does not meet its requirements and cannot be approved but that Pickens-Bond Construction Company (the next low bidder) does meet its requirements and is approved; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS Or THE CITY: Section 1. That, in accordance with the findings and the recommendations of DowSmith Inc . set forth in the letter Page 2 attached hereto and made a part hereof, the Construction Contract for the DowSmith Inc. industrial plant is hereby awarded to Pickens-Bond Construction Company. Section 2. That the Mayor and City Clerk be, and they are hereby, directed to execute the Construction Contract for and on behalf of the City in order that the construction may commence promptly. BOX 2369 • MILWAUKEE 12, WISCONSIN • UPTOWN 3-3414 • AREA CODE 414 May 3, 1963 Board of Directors City of Little Rock City Hall Little Rock, Arkansas Re: Awarding of the Contract for the Construction of the DowSmith Project Gentlemen: Pursuant to the provisions of the Lease and Agreement between the City of Little Rock and DowSmith Inc . dated May 3, 1963, requiring our approval of the contractor to whom the construction contract is to be awarded, we have investigated the qualifications and experience of the two low bidders for the purpose of making a deter- mination as to the approval of DowSmith. As you have been apprised, DowSmith Inc . conducted a thorough in- vestigation prior to reaching a decision to locate the proposed industrial plant in the City of Little Rock. DowSmith Inc. is presently conducting small scale manufacturing operations in Milwaukee and has made elaborate plans which require the transition of operations into the industrial plant in Little Rock on a precise time schedule consistent with production and market requirements . Therefore, it is imperative that the proposed industrial plant be constructed properly and timely or DowSmith will necessarily suffer substantial damages . Our investigation of the two low bidders has included, among other things, financial ability, experience in the construction of industrial facilities and other comparable con- struction work of the magnitude and complexity of this project, and available personnel and equipment to perform the job as required and we have afforded each bidder involved an opportunity to make any presentation along these lines that it desired to make. As a result of our investigation, it is our opinion that N. P. Alessi, Inc. does not meet our requirements for a responsible contractor for the DowSmith project. Alessi, Inc . as the contractor and, therefore, recommend the contract be awarded to the next lowest bidder, Pickens-Bond Construction Company, which in our opinion does meet the necessary requirements . We, of course, intend to cast no reflection on any bidder, but in view of all of the circumstances it is our con- sidered and conscientious opinion that this determination is in the best interests of all concerned, including, of course, the City.
