2940 RESOLUTION NO. 2,940 A RESOLUTION DECLARING OPPOSITION BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK TO SENATE BILL NO. 8, SAME BEING A BILL SUBSTANTIALLY ALTERING CURRENT ANNEXATION PROCEDURES; AND FOR OTHER PURPOSES : WHEREAS, Senate Till No. 8 entitled: "AN ACT to Amend Section 04 of Act 1 of 1875, Regarding Annexation Proceedings by Munici- palities, to Require That an Election on the Question of Annexation Be Held in the Affected Area as Well as in the Municipality Proposing such Annexation; to Provide That the Municipality Shall Present a Petition to the County Court Praying for Such Annexa- tion Only If a Majority of the Votes Cast on the Question in the Municipality and a Majority of the Votes Cast on the Question in the Affected Area Are in Favor of the Annexation; and for Other Purposes. 1° has been proposed for passage by the General Assembly of the State of Arkansas during this session of the General Assembly; and WHEREAS, the principles of annexation procedure affected by the proposed senate fill No. 8 are of vital interest and concern to the City of Little Rock and other growing metropolitan areas within the state of Arkansas in that Senate Bill No. 8 proposes to call for an election not only within cities on the question of annexation of territory but within the area proposed for annexation as well; and WHEREAS, the great weight of authority in law and govern- ment opposes such extra-city elections on the issue of annexation upon the sound reasoning that the city alone can determine its needs for growth and the rate thereof and that there are adequate judicial safeguards to prevent any municipality from annexing territory not characteristically urban nor potentially capable of development for urban uses. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That it ao on record as opposing Senate Bill No. 0 and respectively requests a meeting with the Pulaski County - 2 - delegation to the General Assembly to discuss the propriety of passing Senate Bill No. 6 or any similar legislation at this time. SECTION 2. This resolution shall be in full force and effect from and after its adoption. ADOPTED: January 21, 1963 APPROVED: City Clerk Mayor.
