2933 RESOLUTION NO . 2,933
A RESOLUTION AUTHORIZING AND DIRECTING THE CITY ATTORNEY
TO INITIATE A TEST CASE CONSTRUING THE CITY'S RIGHT TO
USE VOTING MACHINES; AND FOR OTHER PURPOSES .
WHEREAS, the Constitution of the State of Arkansas has
been amended to provide for the use of voting machines; and
WHEREAS, certain portions of Acts of 1949 , No. 484, as
applied, were held unconstitutional by the Supreme Court of the
State of Arkansas subsequent to the passage of said Act; and
WHEREAS, a general election was held in November of 1953
wherein the qualified electors of Pulaski County voted to use voting
machines in elections in said County; and
WHEREAS, much confusion exists as to the power of this
City or of Pulaski County to use voting machines in subsequent
elections under the foregoing circumstances ;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City Attorney of the City of Little Rock
is hereby authorized and directed to institute test litigation toward
the end of determining the status of the law concernin, the use of
voting machines at this time in Little Rock and Pulaski County and
for determining such other questions of law as may be incident there-
to, and to file suit and take such steps as are reasonably necessary
to determine the said question or questions at the earliest practicable
time.
SECTION 2. This resolution shall be in full force and effect
from and after its adoption.
