2881 RESOLUTION NO. 2,881 A RESOLUTION APPROVING AND ACCEPTING THE CONDITIONS AND PROVISIONS OF MINUTE ORDER NO. 4734 OF THE ARKANSAS STATE HIGHWAY COMMISSION DATED AUGUST 2, 1962, PROVIDING FOR MATCHING CITY EXPENDITURES FOR RIGHT-OF-WAY WITH FEDERAL- AID HIGHWAY FUNDS FOR THE PROPOSED EAST-WEST EXPRESSWAY IN THE CITY Of LITTLE ROCK; AND FOR OTHER PURPOSES. WHEREAS, under date of August 2, 1962, the Arkansas State Highway Comaission approved Minute Order No. 4734 authorizing to the maximum amount of Eight Hundred Thousand and No/100 Dollars ($800,000 .00) federal matching funds to the City of Little Rock for acquisition of right-of-way for the East- West Expressway in this City; and WHEREAS, the City of Little Rock desires to accept the provisions and conditions of said Minute Order; NOW THEREFORE BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Minute Order No . 4734 of the Arkansas State Highway Commission dated August 2, 1962, is hereby approved and accepted in its entirety. Said Minute Order is in words and form as follows: "Pulaski 1 2 6 "In PULASKI COUNTY for an EAST-WEST EXPRESSWAY in the vicinity of Eighth Street in Little Rock, from University Avenue to Park Street: WHEREAS, by MINUTE ORDER No. 2977, dated October 7, 1953, the State Highway Commission committed itself to build an expressway type facility if and when monies were avail- able, provided certain conditions were met by the City of Little Rock; and WHEREAS , the conditions of Minute Order No . 2977 have been v r -2- accepted by the City of Little Rock, including a pro- posal by the .:ity that all right-of-way be furnished, clear of obstructions, free of cost to the Mate; and WHEREAS, the City, after a gross appraisal had been made of the proposed route to provide a four-lane expressway type facility, held an election which carried and sold bonds to acquire the right-of-way; and E WHEREAS, after studies were made by the Department it develops that in some stretches of the facility there will be traffic to warrant six lanes, which requires a greater taking of right-of-way than was anticipated in the original concept; and detailed appraisals indicate higher costs to acquire than was originally planned, which makes the amount received from the bond sale inadequate; and WHEREAS, the City of Little Rock, by official request, has petitioned that Federal-aid Highway Funds be made available for matching city expenditures for right-of-way, when eligible; and I WHEREAS, the Highway Coauuission recognized some merit in I the plea of the City; NOW THEREFORE, IT IS ORDERED that the right-of-way to be provided by the City, which has been appraised by standards acceptable to the Bureau of Public Roads, reviewed and ap- proved by the State Highway Department and negotiated for or acquired by condemnation in a manner approved by the State Highway Department and the Bureau of Public Roads, may be submitted to the Bureau of Public Roads for partici- pation in Federal funds to the maximum amount of $800,000 .00. Removal of man-made obstructions can be a part of this offer I by the Highway Department, except that removal and rearrange- ment of utilities will still be the sole responsibility of the City. This action is subject to the acceptance by official action of the Board of Directors of the City of Little Rock, and approval by the Bureau of Public Roads . By Bureau of Public Roads regulations, property acquired prior to this action and program approval cannot be participating in Highway Federal-aid Funds . .11 other provisions and conditions of Minute Order No . 2977 not in conflict with this order are to remain in full force and effect. 9 Chief Engineer 4784 Aug 2 1962" SECTION 2.
