2826 RESOLUTION NO. 2,826 A RESOLUTION ACCEPTING THE LOW BID OF THE METAL PRODUCTS DIVISION, ARMCO STEEL CORPORATION FOR THE CONSTRUCTION OF A METAL RETAINING WALL IN THE VICINITY OF 28TH STREET AND UNIVERSITY AVENUE IN THE CITY OF LITTLE ROCK; AUTHOR- IZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE A CONTRACT WITH SAID CORPORATION; AND FOR OTHER PURPOSES . BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The low bid of the Metal Products Division, Armco Steel Corporation in the amount of Twenty Two Thousand Six Hundred Ninety Five and 03/100 Dollars ($22,695 .03) for the construction of a Metal Retaining Wall in the vicinity of 28th Street and University Avenue in the City of Little Rock is hereby accepted. SECTION 2. The Mayor and City Clerk are hereby authorized and directed to enter into and execute a Contract for the said construction with the Metal Products Division, Armco Steel Corpora- tion, which Contract shall be in form and words as follows: C O N T R A C T • THIS CONTRACT AND AGREEMENT, Made and entered into this day of April , 1962 , by and between Metal Products Division, Armco Steel Corporation Party of the First Part; and The City of Little Rock, Arkansas_ Party of the Second Part, WITNESSETH: That for and in consideration of the payment to be made as hereinafter set forth, the Party of the First Part hereby agrees to furnish all tools, labor, equipment, and materials, and to build and construct Metal retaining wall, back slope and sod embankment, and other appurtenances in exact accord with the Plans on file in the office of the City Clerk and Director of Public Works , Little Rock, Arkansas, designated as Bond Project #3-A , and with the copy of said Plans, Specifications and Proposal being attached hereto and made a part hereof as fully as though copied in full herein under the direct supervision, and to the entire satisfaction of the Director of Public Works of the City of Little Rock,Ark. , subject to inspection at all times in accordance with the laws of the State of Arkansas. It is agreed and understood between the parties hereto that the Party of the First Part agrees to accept and the Party of the Second Part agrees to pay for the work at the prices stipulated in said Proposal, such pay- ment to be in lawful money of The United States, and the payment shall be made at the time and in the manner set forth in the Specifications. The Party of the First Part agrees, for the consideration above express- ed, to begin work within ten days after being ordered to begin work by the Engineer, and to complete the work within Forty-five working days ( 1+5 ) days. If the Party of the First Part shall fail to complete the work in the time herein specified, he shall pay to the Party of the Second Part, as liquidated damages, ascertained and agreed, and not in the nature of a penalty, the sum of Thirty and no/100 dollars ($ 10.00 ) for each day delayed, which shall be deducted from the final amount of estimate made by the Contractor.
