2808 A IL RESOLUTION NO . 2,808 A RESOLUTION ACCEPTING THE LOW BID OF J . R. GROBMYER LUMBER COMPANY IN THE AMOUNT OF NINE HUNDRED FORTY SEVEN AND NO/100 DOLLARS ($947 .00) FOR REROOFING FIRE STATION NO. 9 AT 6TH AND FLETCHER STREETS; AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO ENTER INTO AND EXECUTE A CONTRACT WITH THE SAID COMPANY; AUTHORIZING PAYMENT THEREFOR; AND FOR OTHER PURPOSES. WHEREAS, invitation for bids for the reroofing of Fire Station No. 9 at 6th and Fletcher Streets in the City of Little Rock have been legally published; and WHEREAS, bids have been received and opened pursuant to said advertisement; and WHEREAS, the bid of J . R. Grobmyer Lumber Company in the amount of Nine Hundred Forty Seven and No/100 Dollars ($947 .00) is the lowest responsible and responsive bid submitted therefor; and WHEREAS, the City of Little Rock desires to award a contract for the said project to the Grobmyer Lumber Company; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 02 LITTLE ROCK, ARKANSAS: SECTION 1. The low bid of J . R. Grobmyer Lumber Company in the amount of Nine Hundred Forty Seven and No/100 Dollars ($947 .00) for the reroofing of Fire Station No . 9 at 6th and Fletcher Streets in the City of Little Rock is hereby accepted. SECTION 2 . The Mayor and City Clerk are hereby authorized and directed to enter into and execute on behalf of the City of Little Rock a contract with said Grobmyer Lumber Company for the said project, which Agreement shall be in form and words as follows : A G R E E M E N T WITNESS THIS AGREEMENT made and entered into this day of February, 1962, by and between the CITY OF LITTLE ROCK, ARKANSAS, hereinafter referred to as CITY, and J. R. GROBMYER LUMBER COMPANY of Little Rock, Arkansas, hereinafter referred to as GROBMYER, as follows : 1. That for and in consideration of the promises and covenants hereinafter contained, the payment of moneys and other good and valuable considerations, Grobmyer does agree to furnish all tools, labor, equipment and materials for reroofing Fire Station No. 9 located at 6th and Fletcher Streets in the City of Little Rock, Arkansas, in exact accordance with bid proposals No. 1 and No. 2 and specifications attached hereto and made a part hereof. The said work shall be under the direct supervision of the Director of Public Works of City and shall be completed to the satisfaction of said Director of Public Works in accord- ance with the bid proposals and specifications, and the work done by Grobmyer shall be subject to inspection at all times. 2. The City agrees to pay and Grobmyer agrees to accept as full payment for all work done and materials furnished under this contract the amounts and prices stipulated in bid proposals No. 1 and No. 2, the payment thereof to be made upon acceptance and approval of the said work by the Director of Public Works; provided, however, that the total amount to be paid for the said work shall not exceed the sum of Nine Hundred Forty-seven and No/100 Dollars ($947 .00) . 3. Grobmyer shall begin work within ten (10) days from the date of the work order issued by the Director of Public Works and shall complete the work within ten (10) calendar days from the date of commencement. There shall be no liquidated damages, except that Grobmyer shall pay to City any damages - 2 - sustained to the interior of the building upon which the work is to be done, as a result of Grobmyer' s failure to complete the work within the specified time, except as limited in the bid proposal attached hereto. 4. Grobmyer will cause to be delivered to City a Ten (10) Year Guarantee in standard form issued by the manufacturer covering the shingles installed on the roof of the said building, all in accordance with the bid proposals and specifications. 5. That the work and materials for the said project shall be completed, installed and delivered by Grobmyer to City within the time above stated free and clear from any and all liens, claims and demands of any kind for materials, equipment, supplies, labor, accidental death, injury or otherwise. Grobmyer shall satisfy the Director of Public Works of City that he has in effect at the time of commencement of the work Public Lia- bility and Workmen ' s Compensation Insurance covering the work to be done. The City Manager and Director of Finance are hereby authorized and directed to execute the necessary warrants in payment of the contract price in accordance with the contract authorized herein.
