194201 ORDINANCE NO. 19420 e005087'738 E. 2005 OCT 14 AM 9: 02 2 3 AN ORDINANCE TO ESTABLISH THE RATE OF TAirATMiTC)�CLERK 4 PROPERTY FOR THE CITY OF LITTLE ROCK FOR THE YEAR 2006 5 FOR VARIOUS FUNDS OF THE CITY OF LITTLE ROCK, 6 ARKANSAS; TO DECLARE AN EMERGENCY; AND FOR OTHER 7 PURPOSES. 8 9 WHEREAS, state law mandates that the county quorum court adopt an 10 ordinance prior to the end of the year which establishes the various millage rates for 11 assessments on real and personal property for the coming year, and 12 WHEREAS, on November 4, 2003, the voters of the City of Little Rock 13 authorized the issuance of limited tax general obligation bonds for the purpose of 14 capital improvements within the City, 15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 16 OF THE CITY OF LITTLE ROCK, ARKANSAS: 17 Section 1. The rate of taxation of real and personal property in the City of 18 Little Rock, Arkansas for certain City purposes are hereby fixed, established and levied 19 as follows: 20 (a) For general purposes in order to carry on the affairs of the 21 City Government under Section 4, Article 12 of and Amendment 10 to the 22 Constitution of Arkansas of 1874, there is hereby levied a tax of five (5) 23 mills; 24 (b) For the purpose of paying bonds and interest as may be 25 required for the bonds authorized in Little Rock, Ark., Ordinance No 26 18,941 (September 30, 2003), to repay the City of Little Rock, Arkansas, 27 Capital Improvement Bonds, approved at a special election held on [PAGE 1 OF 3] ORDINANCE Rate of Little Rock Property Tax for 2006 1 November 4, 2003, there is hereby levied a tax of three and three tenths 2 (3.3) mills; 3 (c) For the purpose of paying Policemen's Pensions in 4 accordance with provisions of Amendment No. 31 to the Constitution of 5 the State of Arkansas, a tax of one (1) mill; 6 (d) For the purpose of Paying Firemen's Pensions in accordance 7 with the provisions of Amendment No. 31 to the Constitution of the State 8 of Arkansas adopted November 5, 1940, and Act 16 of the acts otithe 9 General Assembly of the State of Arkansas for the year 1941, a tax o c_oe c� 10 (1) mill; C C') MSTTA.Ar -- 11 (e ) For the purpose of maintaining the City Library, C. 12 accordance with the provisions of Amendment No. 30 to the Constitutin " o 13 of the State of Arkansas, a tax of two and eight tenths (2.8) mills; 14 (f) For the purpose of paying bonds and interest as may be 15 required for the City of Little Rock, Arkansas, for Library System Capital 16 Improvement Bonds, a tax of one (1) mill. 17 Section 2. Since the City achieved equalization in 1989 under the provisions of 18 Amendment 59 to the Arkansas Constitution, the tax rates are the same for both real 19 and personal property. 20 Section 3. Because Pulaski County completed a county -wide reappraisal of 21 property in 2003 it is possible that the millage rates set forth in Section 1 of this 22 Ordinance will be subject to the rollback provisions of Amendment 59 as determined by 23 the Arkansas Assessment Coordination Department; therefore, to the extent that the 24 millage rates in Section 1 are ordered roll backed in accordance with state law, the 25 Board of Directors adopts and ratifies such millage rates. 26 Section 4. The City Clerk is hereby directed to transmit a certified copy of this 27 Ordinance to the County Clerk of Pulaski County so that the taxes recited may be [PAGE 2 OF 31 ORDINANCE Rate of Little Rock Property Tax for 2006 I extended on the tax books of Pulaski County and collected with the other taxes for the 2 year 2004. 3 Section 5. Severability. In the event any title, section, paragraph, item, 4 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid 5 or unconstitutional, such declaration or adjudication shall not affect the remaining 6 portions of the ordinance which shall remain in full force and effect as if the portion so 7 declared or adjudged invalid or unconstitutional was not originally a part of the 8 ordinance. 9 Section 6. Emergency. It is essential to the public health, safety and welfare that the 10 proper millage rates be stated each year, and that this information be promptly communicated 11 with the Pulaski County government in order to assure that appropriate tax millages are put 12 into effect for the following calendar year, an emergency is, therefore, declared to exist and this 13 ordinance shall be in full force and effect from and after the date of its passage. 14 PASSED: October 4, 2005 15 16 ATTEST: APPROVED: 17 18 9�w 19 N taki S.
