2756 �Yz T RESOLUTION NO. 2,756 A RESOLUTION GRANTING A FRANCHISE TO H. L. JONES TO PLACE ARTISTIC ADVERTISING BENCHES ALONG CERTAIN BUS ROUTES IN THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES . BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. A franchise is hereby granted and awarded to H. L. Jones, his heirs and assigns, for a period of ten (10) years from the effective date hereof,to place artistic advertising benches along certain bus routes in the City of Little Rock for the comfort and convenience of the general public . SECTION 2. The said H. L. Jones, his heirs and assigns, are granted the permission to sell advertising space on the front and back of such benches; provided, however, that no ad- vertisement for any alcoholic beverages will be place on any portion of any such bench. SECTION 3 . For and in consideration of such franchise, the said H. L. Jones, his heirs and assigns, agree to pay to the City of Little Rock the sum of Two and No/l00 Dollars ($2.00) per year for each bench placed upon any bus route in the City of Little Rock, said fee being payable in advance annually within thirty (30) days from the effective date or anniversary date of this resolution . Before any bench shall be constructed or placed upon any bus route a permit must be issued by the Director of Public Works and the location of said bench approved by the Di- rector of Traffic,and the consent of the property owner nearest such proposed location shall be required. SECTION 4. All benches hereafter placed along bus routes in the City of Little Rock shall be manufactured or constructed of cement and wood, or of such other materials or combination of materials as may be approved by the Director of Public Works. Each bench shall be approximately seven (7) feet long and two (2) feet wide; the seat and back of which shall be painted with green or brown enamel; the benches shall be kept in good condition and repair at all times and no bench shall be permitted on the bus routes while being repaired or while any of the paint thereon is wet, and further the Director of Public Works of the City of Little Rock is hereby directed to inspect at least annually and report to the Board of Directors, the condition of all benches placed into use in the City of Little Rock pursuant to the authority of this Resolution. SECTION 5. If at any time during the period of the franchise granted herein, or any extension thereof, any public property upon which any bench or benches are located is needed for public purposes, franchisee, his heirs and assigns, will remove such bench at his own expense upon the request of the City Manager of the City of Little Rock or his agents. SECTION 6. Franchisee, his heirs and assigns, shall be responsible hereunder not only for the benches which may hereafter be constructed or established, but for all benches heretofore constructed and established regardless of the location, and shall be responsible for the upkeep, maintenance and state of repair thereof. SECTION 7. If Franchisee, his heirs and assigns, shall fail to perform any of the duties, covenants, or things imposed upon him herein, the City of Little Rock may declare this franchise breached and may terminate same provided said breach is not corrected within thirty (30) days after the breach occurs and notice given by the City of Little Rock to Franchisee. Any assignee of franchisee shall be obligated to notify the City Clerk, Director of Public Works and Director of Traffic of the City of Little Rock of any assignment of all or a part of this franchise within thirty (30) days from the date of any such assignment. SECTION 8. There is hereby granted to Franchisee an option • • 00. -3- to renew this franchise for an additional ten (10) year period beyond the original term hereof upon the same terms and condi- tions as contained herein, except as to the price or rental per bench, which sum shall be subject to renegotiation after the original term hereof.
