A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE A CONTRACT WITH MARION L. CRIST & ASSOCIATES,
INC. , FOR THE PREPARATION OF A MASTER DRAINAGE PLAN
FOR THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES .
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS:
SECTION 1. A contract of employment is hereby awarded
to Marion L. Crist & Associates, Inc. , consulting engineers,
for the preparation of maps, drawings and all data required for
a Master Drainage Plan for the City of Little Rock, Arkansas .
SECTION 2. The Contract of Employment to be executed
by the Mayor and City Clerk of the City of Little Rock and by
Marion L. Crist & Associates, Inc . , is in form and substance as
follows:

KNOW ALL MEN BY THESE PRESENTS:
WITNESS THIS AGREEMENT made and entered into this day of
, 1961, by and between MARION L. URIST & ASSOCIATES, INC ., (here-
inafter called ENGINEER) and the CITY OF LITTLE ROCti, ARAANSAS, (here►-
inafter called CITY),
For and in consideration of the covenants, promises and agreements
herein set forth to be performed by the respective parties hereto, and
the payments herein agreed to be made, the Parties hereto do contract
and agree as follows:
ONE. Atlas Map, The ENGINEER agrees to prepare an Atlas Map of the
City of Little hock and of such territory as is at the time of the
execution of this agreement in litigation for purposes of annexation,
(hereinafter referred to as "area proposed for annexation".) which map
shall consist of sheets approximately 30" by 35", Such sheets, con-
stituting parts of the Atlas Map, as shall depict the area, generally,
between Woodrow Street and the Eastern most lines of the Kock island
Railroad in the City of Little Rock and from the Arkansas River to
Roosevelt Road, or relating to such other areas within the City of
Little Rock as may be stipulated by the Director of Public Works of
the City of Little Rock, shall be at a scale of 1" equals 1001 , each
such sheet or page covering an area of l/L. square mile. Atlas Map
sheets covering the remainder of the area required herein shall be at
a scale of 1" equals 2001 , each sheet covering an area of one (1) square
mile. Each sheet of the Atlas Map shall show all streets, alleys, and
the railroad rights of way and shall show contours, but need not show
the location of lots, numbers of blocks, or dimensions of streets, alleys,
or rights of way.
CITY agrees to furnish ENGINEER with contour maps of the City of
Little Rock and the area proposed for annexation with 5t contour inter
vals, which maps shall be adjusted to the scale of the Atlas Maps in each
such area, Each contour map so supplied by the City shall correspond to
the exact area to be covered by an Atlas Map sheet of said area. CITY
further agrees to furnish ENGINEER with aerial maps of the entire area
covered herein at a scale of 1" equals 6001 ,

TWO. Inventory of Existing Drainage Facilities, ENGJNEEk shall
make a field survey and shall prepare an inventory or all existing
drainage facilities in the uity of Little Rock and in the area proposed
for annexation, and shall show all of such information on or as an
attachment to the Atlas Maps required under Paragraph One hereof. The
inventory of existing drainage facilities shall include: All existing
ditches, drainage ways (with direction of flow designated) ; a cross-
sectional area of all major ditches for drainage ways and the location
and size of all bridges and culverts, except private driveway culverts,
The said inventory further shall include all existing storm sewers, with
inlets and manholes, showing the size, type, condition, and slope of
pipes, area of inlets, and elevations of inverts at manholes and inlets,
In the case of inlets discharging through short pipe lines to an adjacent
ditch, but not a part of a continuous storm sewer system, the depth to
invert from the top- of the structure shall be measured and shown in lieu
of invert grades. Gin agrees to assist ENGINEEh in the work involved
under this Paragraph by making available all existing information con-
cerning the existing drainage system in the uity of Little hock and such
information as it may have relative to the area proposed for annexation,
TtittEE. Master Drainage System. ENGINEER agrees to make a detailed
study of all drainage problems in the city of Little hock and the area
proposed for annexation, determining the required locations and sizes of
culverts, bridges, drainage ways, storm sewers and inlets throughout the
area which shall be capable of adequately serving as a General Master
Plan for the future development of a storm drainage system in the uity
of Little hock, which information shall be shown on the Atlas Map re»
quired under Paragraph One hereof.
FOux. Drainage Report, Upon completion of the Atlas Map and the
engineering surveys, studies and computations required under the first
three Paragraphs of this contract, ENGINEER agrees to prepare a report
discussing the drainage problems in each drainage area within the uity
of Little Rock and the area proposed for annexation, with preliminary
cost estimates supplied relative to the necessary improvements in each
such area, The report shall point out and define deficiencies in the
condition of existing drainage facilities and shall include a list of
the most needed improvements in the order of their relative urgency
and significance to assist the CITY in determining a priority for con..

struction,
FIVE, Form of Report. The report called for in Paragraph Four
hereof shall be in bound form and at least twelve (12) complete copies
shall be delivered to ul'TY. ENGINEER agrees to submit and deliver, with
the Engineering Report, required in Paragraph Four hereof, the original
tracing on cloth of all of the sheets used in the Atlas Map, whereupon
VI'1`Y will furnish to ENGINEER, within a reasonable time, one (1) set of
paper sepia reproducibles of said original cloth tracings,
SIX. Payments. For the services to be performed by ENGINEER for
and in behalf of ui TY, outlined under Paragraph One above, u1TY agrees
to pay to ENGINEER the sum of Seven Thousand and No/100 Dollars ($7,000.00)
for the area within the existing uity Limits as of the date of this con.,
tract and the sum of One Thousand Five Hundred and No/100 Dollars ($1:500,00)
for the area proposed for annexation.
For the services outlined under Paragraph Two above, GI'1Y agrees to
pay to ENGINEER the sum of Twenty Two Thousand and No/100 Dollars $22,000.00)
for the area within the present uity Limits as of the date of this contract
and the sum of Four Thousand and No/100 Dollars ($4,000.00) for the area
proposed for annexation,
For the work outlined under Paragraph Three above, GITTY agrees to
pay to ENGINEER the sum of Six Thousand Eight Hundred and No/100 Dollars
($),ti00.00) for the area within the present uity Limits as of the date
of this contract and One Thousand Six Hundred and No/100 Dollars ($1,600,00)
for the area proposed for annexation.
For the work included under Paragraph Four and Five above, the v11'Y
agrees to pay to ENGINEER the sum of Five Thousand Three Hundred and
No/iOO Dollars ($,300.00) for the area within the present city Limits
as of the date of this contract and One Thousand Eight Hundred and No/100
Dollars ($1,oOO.00) for the area proposed for annexation.
The above stated sums shall become due and payable upon the
completion and acceptance by CITY of each phase of the work defined by
paragraphs herein, except that no more than four (4) progress payments
shall be made upon rendition of statements and such statements shall not
exceed Ninety Per cent (907) of the value of work completed on the date
of the statement as determined by the CITY.

SEVEN , Miscellaneous. it is understood and agreed that ENGINEER
will begin the work covered by this contract within thirty (30) days
after the date of execution of this contract and will pursue the work
defined herein diligently to completion within a period of one (1) year
after the date hereof.
it is further understood and agreed that the uITY may, in its
discretion, instruct ENGINEER to proceed only with the work applicable
to the area within the city Limits of Little Rock as of the date of this
contract, in which event, ENGINEER will be under no duty to commence work
in the area proposed for annexation until a work order shall have been
given by c1TY. The fees payable hereunder for work to be done within the
City Limits of Little hock as of the date of this contract shall be paid
as provided herein and no liability shall accrue against the CITY here.
under for work to be done in the area proposed for annexation until
after a work order shall have been entered by the CITY for such work,
in which event, payments shall be made on such work pursuant to the terms
of this contract.
E1GhT. AMENDMENTS AND ALTERATIONS. In the event CITY shall decide
to modify, enlarge upon, or delete any part of the work to be performed
by ENGINEER, such savings of cost to ENGINEER or increase of cost to
ENGINEER shall be negotiated by and between ENGINEER and CITY at such
price or prices per unit as may be fair and equitable to the Parties
hereto, and the payments required hereunder shall be adjusted accordingly.
WITNESS the hand and seal of the Parties hereto on the date first
above mentioned.

SECTION 3 . The Mayor and City Clerk are hereby authorized
and directed to sign for and in behalf of the City of Little Rock
the document described in Section 2 hereof.
SECTION 4. This resolution shall be in full force and
effect from and after its adoption.
