A RESOLUTION ACCEPTING THE LOW BID OF Z . T. RUSSOM PLUMBING
COMPANY IN THE AMOUIT OF ONE THOUSAND TWO HUNDRED AND NO/
100 DOLLARS ($1,200 .00) FOR THE PLUMBING W0RK. ON THE JAIL
EXPANSION AT THE POLICE & COURTS BUILDING IN THE CITY OF
LITTLE ROCK, ARKANSAS; AUTHORIZING AND DIRECTING THE MAYOR
AND CITY CLERK TO EXECUTE AN AGREEMENT WITH 'THE SAID PLUMBINI
COMPANY FOR THE WORK TO BE PERFORMED; AUTHORIZING AND APPROVING
THE EXPENDITURE OF FUNDS THEREFOR; AND FOR OTHER PURPOSES
WHEREAS, invitation for bids for the plumbing work on the jail
expansion at the Police & Courts Building in the City has been legally
published; and
WHEREAS, the bids have been received and opened pursuant to said
advertisement; and
WHEREAS, the bid of Z . T. ?.ussomn Plumbing Company is the lowest
responsible bid submitted therefor; and
WHEREAS, the City of Little Rock desires to award the contract
for the said work to Z . r. RussoP Plumbing Company; and
WHEREAS, the City has previously appropriated certain sums of
money from the 1958 Bond Construction Funds for this project; and
WHEREAS, the Board of Directors of the City of Little lock desires
to authorize the expenditure of One Thousand Two Hundred and No/100
Dollars ($1,200 .00) from the Public Buildings Construction Fund, Pro-
ject 30, previously appropriated;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The low bid of Z. F. RussoM Plumbing Company in the
' , amount of One Thousand Two Hundred and No/100 Dollars ($1,200 .00) for
the plumbing work to be performed in connection with the jail expansion
at the Police & Courts Building in the City of Little Rock is hereby
approved.
SECTION 2. The Mayor and City Clerk are hereby authorized and
directed to enter into and execute an Agreement on behalf of the City
of Little Rock with Z. T. Russom Plumbing Company for the said plumbing
work, which Agreement shall be in form and words as follows:

THIS AGREEMENT made the day of in the year

1961, by and between Z. T. RUSSOM PLUMBING COMPANY, hereinafter called
CONTRACTOR, and the CITY OF LITTLE ROCK, ARKANSAS, acting by and through
its Mayor and City Clerk, pursuant to the provisions of Resolution No.

, hereinafter called the OWNER, WITNESSETH, that the CONTRACTO
and the OWNER for the considerations hereinafter named agree as follows:
ARTICLE 1. SCOPE OF THE WORK--CONTRACTOR shall furnish all of the
lumbin', materials and perform all of the plumbing work shown on the
drawings and described in the specifications entitled "Alternate J-1, ` '
Police & Courts Building, City of Little Rock, Arkansas, also identified
as "Addendum Number One-A to Specifications for Police & Courts Building, :
City of Little Rock, Arkansas, prepared by Erhart, Eichenbaum, Rauch
and Blass, 201 Chester Street, Little Rock, Arkansas, acting as and in
these Contract Documents entitled the Architect; and shall do everything
required by this Agreement, the General Conditions of the Contract, the

'Specifications and the Drawings. It is understood by and between the
Parties hereto that this Contract covers solely the plumbing work des-
cribed in said plans and specifications under Alternate J-1 to the plans li
IIand specifications, the remainder of the work under said plans and
specifications having been previously contracted for or completed.
ARTICLE 2. TIME OF COMPLETION—The The work to be performed under T'1�._.

ARTICLE 3 . THE CONTRACT SUM- -The OWNER. shall pay the CONTRACTOR
for the performance of the Cnntrert, subject to additions and deductions

CONTRACTOR, there shall be an equitable adjustment of the Contract
to prevent such hardship .
ARTICLE 4. ACCEPTANCE AND PAYMENT--The OWNER shall make one
payment to CONTRACTOR upon the completion of the contract according
to the plans and specifications when, if and as approved by the ARCHI-
TECT. Payment shall be due 15 days after substantial completion of
the work, provided the work be then fully completed and the contract
fully accepted.
Upon receipt of the written notice that the work is ready for
final inspection and acceptance, the ARCHITECT shall promptly make
such inspection, and when he finds the work acceptable under the Con-
tract and the contract fully performed, he shall promptly issue a
final certificate over his own signature stating that the work pro-

vided for in this contract has been completed and is accepted by him
under the terms and conditions thereof, and that the contract price
found to be due the CONTRACTOR is due and payable .
Before issuance of the final certificate, the CONTRACTOR shall
submit evidence satisfactory to the ARCHITECT that all payrolls, material
bills and other indebtedness connected with the work have been paid.
If after the work has been substantially completed, full completion
there of is materially delayed through no fault of the CONTRACTOR, and
the ARCHITECT so certifies, the OWNER shall, upon certificate of the
ARCHITECT, and without terminating the Contract, make payment of the
balance due for that portion of the work fully completed and accepted.
Such payment shall be made under the terms and conditions governing
final payment, except that it shall not constitute a waiver of claims.
ARTICLE 5 . THE CONTRACT DOCUMENTS--The General Conditions of the
Contract, the Specifications and the Drawings, including Alternate J-1
to the original Plans and Specifications and Addendum number One-A to
Specifications for Police & Courts Building, together with this Agree-
ment, form the Contract, and they are as fully a part of the Contract
as if hereto attached or herein repeated. The following is an enumeration
of the Specifications and Drawings:

Sheet Nos . J-1 through J-6, inclusive; Structural - Sheets No. S-1

P-4, inclusive, and Sheet Nos . M-1 through M-5, inclusive; and Electrical-
Sheet Nos. E-1 through E-5 ,inclusive.

SECTION 3 . There is hereby authorized and approved the expendi-

SECTION 4-. The City Manager and Director of Finance are hereby
authorized and directed to execute the necessary warrant or warrants
in payment of moneys approved in Section 3 hereof.
SECTION 5 . This resolution shall be in full force and effect
from and after its adoption .
