A RESOLUTION APPOINTING MR. JAMES F . HEWITT AND MR. G. W. BLANKENSHIP
AS A COMMITTEE OF THE BOARD OF DIRECTORS TO INSPECT UNIVERSITY AVENUE
BEFORE THE ACCEPTANCE BY THE CITY OF SAID PROJECT AND FINAL PAYMENT
IS MADE THEREFOR; AND FOR OTHER PURPOSES.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. A coaiaiittee constituted of Mr. James F. Hewitt and
Mr. G. W. Blankenship is hereby appointed for the purpose of in-
specting and determining compliance with the contract or contracts
with the City of Little Rock by any and all contractors performing
work upon University Avenue in the City of Little Rock, Arkansas.
SECTION 2. The Committee created and appointed in Section 1
hereof shall determine what damages, if any, have accrued to the
City of Little Rock by reason of the delay in completion on the part
of the contractor or contractors and to find as a question of fact
how much, if any, delay was due to the fault of the said contractor
or contractors and how much of the delay in completion was due to
factors outside of the control of the said contractor or contractors;
to investigate and determine the quality of workmanship performed by
the contractor or contractors in the widening and construction of
University `.venue; and to determine if in fact the contract or con-
tracts between the City of Little Rock and the prime contractor or
other contractors has been fully complied with in all respects . The
Committee shall report their findings to the Board of Directors at
the earliest possible Arne and no payment or payments shall be made
as final and full settlement, nor shall any retainage be paid,until
the Conu►►ittee shall have acted and reported.
SECTION 3 . This resolution shall be in full force and effect from
and after its adoption.
