2349 RESOLUTION NO. 2349 A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AND ENTER INTO A CONTRACT WITH GRADY GARMS FOR THE REPAIR OF GILLAM PARK SWIMMING POOL AND WADING POOL; AND FOR OTHER PURPOSES. WHEREAS, invitation for bids for the repair of the Gillam Park Swimming Pool and Wading Pool at Gillam Park has been legally published; and WHEREAS, bids have been received and opened pursuant to said invitation; and WHEREAS, the Board of Directors desires to award the contract to the lowest responsible bidder therefor; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. A contract for the repair of the Gillam Park Swimming Pool and Wading Pool at Gillam Park at a cost to the City of Little Rock of Six Thousand Five Hundred Thirteen and 25/100 Dollars ($6,513 .25) is hereby awarded to Grady Garms as the lowest responsible bidder therefor. SECTION 2. The Mayor and City Clerk are hereby authorized and directed to execute and enter into a Contract with Grady Garms for the repair of the Gillam Park Swimming Pool and Wading Pool pursuant to the bid proposal and plans and specifi- cations for said repair, all of which shall be in form and words as follows: "CONTRACT This agreement made and entered into this day of May, 1959 , between the City of Little Rock, Arkansas, acting through its Mayor and City Clerk pursuant to the provisions of Resolution No. , hereinafter referred to as 'City' and Grady Garms, Little Rock, Arkansas, hereinafter re- ferred to as 'Contractor ' WITNESSETH: -2- That the Contractor for the consideration, purposes and covenants hereinafter set out hereby covenants and agrees to repair the Gillam Park Swiuuuing Pool and Wading Pool according to the following specifications: 1. Contractor shall furnish all materials, equipment,and labor to repair the Gillam Park Swiuuuing Pool and Wading Pool in accordance with specifications outlined herein and as directed by the Engineer. The Engineer shall be the Director of Public Works of the City of Little Rock or his authorized agent . 2. The existing bottom of the pool shall be thoroughly cleaned of all loose spalled concrete as directed by the Engineer. A four inch (4") , 3000 psi, air entrained, low slump, con- crete slab, reinforced with #6 wire mesh, welded on 6" centers both ways, shall be poured over entire pool bottom. Concrete shall be trowel finished and membrane cured as I directed. All existing joints in the pool bottom shall be cleaned, old joint material removed, and packed with dry jute, primed and repoured with PRC or equal joint material at the direction of the Engineer. A SEALTIGHT PVC No . 6380 or equal water stop shall be used in all pool bottom ex- pansion joints at the direction of the Engineer. 3. Cracks in the pool walls shall be beveled to a depth speci- fied on plans, primed and poured with PRC or equal joint material as directed by the Engineer. Expansion joints and spalled areas shall be handled in same manner as specified for bottom. 4. Broken areas in the swimming pool deck shall be cut out to neat lines using concrete saw and voids backfilled and com- pacted as directed by the Engineer. Cut out areas shall be replaced with 3000 psi concrete reinforced in the same -3- manner as the existing deck. Spalled areas in the deck surface shall be thoroughly cleaned and plastered with 1:3 mix using WELD-CRETE or equal bonding agent as directed by the Engineer. 5 . The wading pool shall be repaired by thoroughly cleaning and removing the spalled material from the bottom, sides and deck as directed by the Engineer, and plastered with 1:3 mix, using WELD-CRETE or equal bonding agent . The Contractor agrees to furnish, subject to the approval of the City Attorney as to content and form, a bond in the sum of Six Thousand Five Hundred Thirteen and 25/100 Dollars ($6,513.25) , of good and sufficient corporate surety, to guar- antee the faithful performance of the Contract and to indemnify the City against any damages or losses or any action caused by or due to this work. The Bond shall be and remain in effect from the date of execution of this Contract until the completion and acceptance of the job, and for a period of one year after said acceptance by the City Engineer. The Bond shall particularly guarantee the payment of all claims for damages, materials, and equipment furnished for the work and for all labor performed. The Contractor hereby covenants and agrees to indemnify and save harmless the City from any and all claims, damages, losses or any liability whatsoever arising out of, or caused by, or due to work performed under this Contract or related thereto. It is mutually understood and agreed that time whenever mentioned in this Contract is an essential part of this agree- ment, and inasmuch as the damages to the City due to the failure of the Contractor to complete this contract by the date specified, are uncertain and difficult of determination, that said Contractor agrees that if said work is not completed on or before the date named for its completion, the Contractor shall and will pay to the City as agreed as liquidated damages, and not in the nature of a penalty, the sum of Twenty Five Dollars ($25 .00) per calendar day which shall compensate the City for the extra cost of services and expenses of the City for the extra time required for the completion of the work. 'Extra time' shall in all cases be I I -6- construed as the time required for completion after the date of completion named in this Contract. The City for the consideration, purposes and covenants hereinabove set forth hereby agrees to pay the Contractor the sum of Six Thousand Five Hundred Thirteen and 25/100 Dollars ($6,513.25) upon completion and acceptance by the City Engineer of the hereinabove described repairs as full payment therefor.
