2100 RESOLUTION NO. 2100 A RESOLUTION AUTHORIZING THE MAYOR AND THE CITY CLERK OF THE CITY OF LITTLE ROCK, ARKANSAS, TO EXECUTE A DEED RELEASING CERTAIN LANDS NOT NEEDED FOR A SEWER EASEMENT UPON AND ACROSS LOT 9, RANCH VALLEY, AN ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS, AND UPON AND ACROSS BLOCK 3, PLEASANT HILL ADDITION TO LITTLE ROCK, ARKANSAS. WHEREAS, on April 25, 1936, H. H. Conley and Marie Cates Conley, his wife, the then owners of an undivided one-half interest in the SE* of the NE of Section 36, Township 2 North, Range 13 West, Pulaski County, Arkansas, did execute and deliver to the City of Little Rock, Arkansas, an easement for the construction of a sanitary sewer line over and across said lands, which said easement is of record in Book 251, at Page 76, of the Deed Records of Pulaski County, Arkansas; and on 30, 1936, Mrs . Roy L. McKinney, the then owner of the other undivided one-half interest in said lands did execute and deliver to the City of Little Rock a similar easement, which said easement is of record in Book 251, at Page 69, of the Deed Records of Pulaski County, Arkansas; and, WHEREAS, on March 22, 1955, a plat was filed for record and is of record in Plat Book No . 5, at Page 14, in the Office of the Re- corder of Pulaski County, Arkansas, under which a. portion of the SE* of the N.F.;` of said Section 36 was platted as Ranch Valley, an Addition to the City of Little Rock, Pulaski County, Arkansas, and said sewer easement or right of way traverses Lot 9 of said Addition; and, WHEREAS, on April 25, 1936, Arthur Lewandoski and Mrs . Arthur Lewandoski, the then owners of Block 3, Pleasant Hill Addition to Little Rock, Arkansas, did execute and deliver to the City of Little Rock, Arkansas , an easement for the construction of a sanitary sewer line over and across said lands, which said easement is of record in Book 243, at Page 484, of the Deed Records of Pulaski County, Arkansas; and, WHEREAS, said sewer has now been constructed and its exact location is known and an easement covering all of Lot 9, Ranch Valley, an Addition to the City of Little Rock, Pulaski County, Arkansas, and all of Block 3, Pleasant Hill Addition to Little Rock is not essential or necessary and the existence of the present recorded easements covering all of said lands results in an undue hardship upon the present owners thereof and makes it impossible for them to mortgage or to convey said lands, and, therefore, said easements should be reduced to the width of ten ( 10) feet and all adjoining lands re- leased therefrom. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1 . That the Mayor and the City Clerk of the City of Little Rock, Arkansas, be and they are hereby authorized and directed to execute a deed in the name of the City of Little Rock, releasing all of Lot 9 of Ranch Valley, an .Addition to the City of Little Rock, Pulaski County, `�rka.nsas, from the sewer easements executed April 25, 1936, of record in Book 251, at Page 76, of the Deed Records of Pulaski County, Arkansas, and from the sewer easement executed April 30, 1936, of record in Book 251, at Page 69, of the Deed Records of Pulaski County, -.rkansas, except a. strip ten ( 10) feet in width, being five (5) feet in width on both sides of a center line described as beginning at a point on the South line of said Lot 9, being located 74.5 feet Jest of the Southeast corner of said Lot 9 and 764.7 feet ,Jest of the SE4 of the NE,'i of Section 36, Township 2 North, Range 13 -Test, Pulaski County, Arkansas, run thence North 0 degrees 32 minutes West 14.1 feet to the center of manhole No. 130, run thence North 29 degrees 23 minutes East to a point on the Northerly line of said Lot 9 and on the Southerly right of way line of Ranch Valley Road. SECTION 2. That the Mayor and the City Clerk of the City of Little Rock, Arkansas, be and they are hereby authorized and Directed to execute a deed in the name of the City of Little Rock, Arkansas, releasing all of Block 3, Pleasant Hill Addition to Little Rock, from the sewer easement executed : pril 25, 1936, of record in Book 248, at Page 434, of the Deed Records of Pulaski County, Arkan- sas, except a. strip ten (10) feet in width, being five (5) feet in width on both sides of a. center line described as beginning at a point on the South line of said Block 3 located 37 feet West of the Southeast corner thereof, run thence North on a straight line to a. point in the North line of said Block 3 located 88 feet distant from w I. •� 3. the Northeast corner of said Block 3.
