1992 RESOLUTION NO. 1992
A RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY OF THE CITY OF LITTLE ROCK TO MAKE SET-
TLEMENT WITH THE LITTLE ROCK SCHOOL DOARD AND THE
FRATERNAL CEMETERY COMl'IISSION IN CASE NO. 39786.
WHEREAS, the Little Rock School board filed condemnation
proceedings in Case No. 39786 for property belonging to the
City of Little Rock and, being supervised by the Fraternal
Cemetery Commission, for school purposes ; and
WHEREAS, by agreement a sum of 24,000 was paid into the
Pulaski Circuit Court for distribution to the City cf Little
Rock and/or the Fraternal Cemetery Commission; and
WHEREAS, the Fraternal Cemetery Commission is required to
use such funds as they received for the improvement and care
of said Cemetery; and
WHEREAS, said sums deposited are in excess of the immedi-
ate needs of the Fraternal Cemetery; and
WHEREAS , the City of Little Rock has use for said funds
and is entitled to all or a portion thereof of said funds ; and
WHEREAS, the Fraternal Cemetery Commission has prepared
plans for the improvement of said Cemetery, which plans require

WHEREAS, it is to the best interest of the City of Little
Rock that litigation be avoided with the Fraternal Cemetery
Commission.
NOW , THEREFORE, BE IT RESOLVED EY Thh CITY COUNCIL OF THE
CITY OF LITTLE ROCK, ARKANSAS :
That the City Attorney of the City of Little Rock shall
settle said litigation to the extent that the Fraternal Ceme-
tery Commission shall receive ��. 00O
of the settlement,
and funds now in the registry of the Court, and that the sum of

of Little Rock.
