1986 RESOLUTION NO. 1986 A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO ACCEPT THE SUM OF $24,000.00 LESS $300.00 COSTS FOR APPRAISERS FOR CERTAIN PROPERTY OWNED B1 THE CITY OF LITTLE ROCK AND CONDEMNED BY THE LITTLE ROCK SCHOOL DISTRICT FOR SCHOOL PURPOSES ; PROVIDING FOR THE RE-BURIAL OF BODIES IN CERTAIN PORTIONS OF SAID PRO- PERTY LOCATRD IN FRATERNAL CEMETERY; AND FOR OTHER PURPOSES. WHEREAS Little Rock School District has instituted a suit in the Pulaski Circuit Court against the City of Little Rock and the Board of Commissioners of Fraternal Cemetery for the purpose of acquiring title to the following described real property, to-wit: All that part of the Southwest Quarter of the Southeast Quarter (SW4 SE4) of Section 11, Township 1 North, Range 12 West, Pulaski County, Arkansas, described as follows: Commencing at a point where the north boundary line of East Roosevelt Road intersects the west line of said SW4 of SE4, and running thence North along the west line of said SW4 of SE4 150 feet ; thence East 570 feet; thence South 450 feet to the north boundary line of East Roosevelt Road; and thence West along the north boundary line of East Roosevelt Road to point of beginning, and WHEREAS, 0. D. Longstreth, Jr. , City Attorney, in order to ascertain the value of the property agreed to arbitration by three Little Rock real estate brokers; and WHEREAS, W. E. Porterfield, Jack R. Tucker and E. A. McCaskill acted as arbitrators and fixed the value of the property at 324,000; and WHEREAS, Little Rock School District has accepted the figure of 324,000 as being the fair market value of the property3 NOW, THEREFORE, BE IT RESOLVED, That 0. D. Longstreth, Jr. , as City Attorney of the City of Little Rock be, and he is hereby authorized to accept such figure as being the fair market value of the property involved in said suit, and that he be authorized to consent to a judgment vesting the title to said property in Little Rock School District upon condition that Little Rock School District take the said property with notice that a portion of it has been used by Fraternal Cemetery for burial purposes and that it will, at its expense, remove the bodies buried within the boundaries of said property and rebury them in that portion of Fraternal Cemetery which will be designated by the Commissioners of said Fraternal Cemetery, the removal and reburial to be done in accordance with the directions given by said Commissioners; and upon the further condition that Little Rock School District will save the City of Little Rock harmless against all claims, if any, arising from the removal of the bodies, as aforesaid. BE IT FURTHER RESOLVED That said 0. D. Longstreth, Jr. , as City Attorney of the City of Little Rock, be authorized to agree that out of the moneys deposited in the registry of the court by Little Rock School District for the benefit of City of Little Rock or Commissioners of Fraternal Cemetery there shall be deducted and paid to the said W. E. Porterfield, Jack R. Tucker and E. A. McCaskill the sum of 3100 each for their ser- vices in appraising the value of said property.
