1848 RESOLUTION NO. 1814.8
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LITTLE ROCK, ARKANSAS FOR CLOSING OF ALLEY IN
BLOCKS 6, 11 AND 22 IN CUNNINGHAM'S ADDITION TO
THE CITY OF LITTLE ROCK
WHEREAS, by the original plat of Cunningham's
Addition to the City of Little Rock, Arkansas , as recorded
in the Office of the Circuit Clerk and Ex-Officio Recorder
for Pulaski County, Arkansas, there was dedicated to the
public an alley 20 feet wide, running North and South
through the middle of Blocks 6, 11 and 22 of the said
Cunningham's Addition; and
WHEREAS, the said alley has never been opened
or improved and has never been used by the public generally
as a passageway or for any other purposes ; and
WHEREAS, the said alley is not now needed for
highway purposes and for use as a passageway for the public
generally; and
WHEREAS, it is to the best interest of the City
of Little Rock, Arkansas that Capital Transportation Company
be granted a right-of-way for the construction of a street
and roadway over a portion of the said alley as dedicated;
and
WHEREAS, the public welfare of the City of Little
Rock will be enhanced and promoted and the best interests
of the said city will be advanced by the closing and abandon-
ing of the said alley so that a private right-of-way may be
granted to the said Capital Transportation Company for the
above described purposes ; and
WHEREAS, the City of Little Rock, Arkansas itself
is the owner of all of the real estate situated in Blocks
11 and 22 and of Lots 1, 2, 3 and 4, Block 6, Cunningham's
Addition; and
WHEREAS, all of the owners of all of the other
real estate situated in Block 6, Cunningham's Addition,
together with the owners of all conduits, pipes , cables,
poles and overhead wires erected or installed along or
across the alley hereinabove described, have agreed in
writing to the closing and abandoning of the said alley;
and
WHEREAS, by Section 1 of Act 210 of the Acts of
the General Assembly of the State of Arkansas for 1931
this City Council is authorized by resolution to direct
the Mayor and City Clerk of the City of Little Rock) Ark-
ansas to join in the said written agreement and thereby
effect the closing and abandoning of the said alley;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THF, CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. That this City Council join in a written
agreement with the other owners of real property situated
in Blocks 6, 11 and 22 of Cunningham' s Addition, to close
and abandon the alley running North and South through the
middle of the said blocks, according to the original plat
of the said Cunningham's Addition to the City of Little Rock,
Arkansas , to the end that the rights of the owners of pro-
perty within the said blocks and the rights of the public
generally to use the said alley as a passageway according
to the original dedication for that purpose may be vacated
and forever foreclosed.
SECTION 2. That the Mayor and City Clerk of the City of
Little Rock be and they are hereby authorized and directed
to execute on behalf of the City of Little Rock a written
agreement with the owners of other real estate in the afore-

described blocks to close and abandon the said alley.
SECTION 3. That a copy of this resolution, duly certi-
fied by the City Clerk of this City, be attached to the
said written agreement and recorded along with the said
agreement in the Office of the Circuit Clerk and Ex-Officio
Recorder for Pulaski County, Arkansas as evidence of the
vacating and abandoning of the said alley.
