RESOLUTION NO. 1770.
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE AN EASEMENT DIED ON BEHALF OF THE CITY
OF LITTLE ROCK TO LITTLE ROCK-PULASKI DRAINAGE
DISTRICT NO. 2 OF PULASKI COUNTY, PROVIDING FOR
THE USE BY SAID DISTRICT OF CERTAIN PARCELS OF
LAND WITHIN SAID DISTRICT AND BELONGING TO SAID
CITY; DECLARING AN EMERGENCY; AND FOR OTHER PUR-
POSES.
WHEREAS, Little Rock-Pulaski Drainage District No. 2 of
Pulaski County, is an improvement district duly organized under
the statutes of the State of Arkansas and orders of the County
Court of Pulaski County, for the purpose of acgziring from the
owners thereof easements over certain lands upon Which the U. S.
Engineers plan to construct a levee around a portion of Little
Rock known as the "East End" together with drainage ditches,
storage reservoirs, diversion channels and other works necessary
for the main purpose, and
WHEREAS, the City of Little Rock in its own right and in
fee owns certain tracts of land hereinafter described, and
WHEREAS, the said drainage district desires a right-of-
way easement deed to the hereinafter described lands for the pur-
poses heretofore set out, and
WHEREAS, the said described lands have been viewed and
appraised by the Little Rock Real Estate Board and the Board of
Appraisers appointed by the Circuit Court of Pulaski County and
said Boards have each fixed the sum of Twenty five Hundred Dollars
42500.00) as a fair market value of an easement deed to said
lands and consequential damages to lands not included in said
description and the City of Little Rock is willing to convey a/.
easement in said lands in consideration of said sum, and
WHEREAS, the City of Little Rock is the owner of other
lands in said district on which the Board of Commissioners of
theDistrict have fixed an assessment of betterments to same by
the construction of the levee and other works in the sum of Seventy
Thousand, Two Hundred Twenty six Dollars (§70,226.00) and the City
of Little Rock has been requested by the district to pay said
sum, less the amount of Two Thousand Dollars (y2,O00) heretofore
paid, to said district as a proper assessment by said district
against said lands for the purpose of protecting said lands from
overflow and excess surface water, and
WHEREAS, it is desired by the City of Little Rock that
the amount appraised as the damages for the taking of the lands
hereinafter described to-wit: Twenty five hundred Dollars ( 2500.00)
be credited on the amount of the assessment on other lands situa-
ted in the district as set out above,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF LITTLE ROCK, ARKANSAS:
SECTION I. That the sum of Twenty five Hundred Dollars
(0500.00) fixed by the Little Rock Real Estate Board and the
appraisers appointed by the Circuit Court as value of the lands
of the City hereinafter described and damages to adjacent lands
be accepted and that said sum be retained by the drainage dist�
rict as a credit on any payment made by the City of Little Rock
on the assessment of benefits to other lands of the City located
in said district.
SECTION II. That the Mayor and City Clerk be and they are
hereby authorized to execute and deliver to Little Rock-Pulaski
Drainage District No. 2 in consideration of the aforesaid, an
easement deed to the following lands located in Pulaski County,
to-wit:
Lots Seven (7), Eight (8), Nine (9), Ten (10),
Eleven (11) , Twelve (12) , Block Forty eight (48)
Industrial Park Annex No. 2 Addition;
Lots Four (4), Five (5), Six (6), Seven (7 ), Block
Fifty three (53), Industrial Park Annex No. 2
Addition;
South eighty (80) feet of Lot Two (2), South One
Hundred (100) feet of Lot 3, South One Hundred ten
(110) feet of Lot Four (4), East Half (E ) of Lot
Five (5), Block Fifty eight (58), Industrial Park
Addition.
SECTION III. It is ascertained and declared by the City
Council of Little Rock that the City is in urgent and immediate
need of the protection to life, health and property afforded by
the levee and drainage works proposed to be constructed by the
U. S. Government in the area described.
It is therefore declared that an emergency exists; that
this resolution is necessary for the immediate preservation of
the public peace, health and safety and that this resolution
shall take effect and be in force from and after its passage.
