1769 RESOLUTIO N.„R10. 1769 A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE, FOR THE CITY OF LITTLE ROCK, A WAIVER OF RIGHT TO PURCHASE CERTAIN LANDS NOW OWNED BY THE UNITED STATES OF AMERICA: DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. WHEREAS, the United States of America, acting through the War Assets Administration and the Federal Land Bank, is offering for sale as surplus, certain lands in Section 18, Township 1 North, Range 11 West and Section 13, Township 1 North, Range 12 west in Pulaski County, and WHEREAS, The City of Little Rock has a priority as a local Govern- ment to purchase said land, and WHEREAS, the Little Rock-Pulaski Lrainage District No. 2 desires to acquire a rightf-way over a portion of said lands, and also have a -I lt'e priority of the City of Little hock to purchase said lands, and desires to exercise said right to purchase said right-ot-way, and WHEREAS, the City of Little Rock is willing to waive and subordinate its right to purchase said lands in favor of said District, NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the City of Little Rock waive and subordinate, in favor of Little Rock-Pulaski Drainage District No. 2 its right and privi- lege to purchase from the United States of America, the lands hereinafter described, and consents that the said District may acquire said land ahead of any right or priority of the City. Section 2. That the Mayor and City Clerk be and they are hereby authorized to execute and deliver to the Little Kock-Pulaski Drainage District No 2, a :wa.iver or subordination in favor of said District to purchase from the United States of Americas the following described lands in Pulaski County, Arkansas, to-wit: Resolution, page 2 SECTION 18,TIN,R11W. Right-of-way described as: Beginning at a point which is the intersection of the North-South quarter line of section 18 and the North line of Thirtieth otreet, Factoria Addition to the City of Little Rock, rirkansas; thence West along said North line of Thirtieth Street, 2,400 feet to the East line of the Missouri Pacific Railroad night-of-way; thence Northwesterly along said East line 110 feet to the West line of section 18; thence North along said west line 720 feet; thence south 85 degrees 16 minutes East 415 feet; thence South 4 degrees 44 minutes West 150 feet; thence South 85 degrees 16 minutes East 1450 feet; thence South 2 degrees 49 minutes west 35 feet; thence East 625 feet to North-South quarter line of Section 18; thence south along said quarter line 480 feet to beginning, containing 33,34 acres more or less. SECTION l3, TLNi R12 W Right-of-way described as: Beginning a.t a point on the East line of section 13, 1230 feet South of the NE corner; thence South along said East line 715 feet to the East line of the Missouri Pacific Railroad right-of-way; thence Northwesterly along said east right-of-way line 855 feet; thence south 85 degrees 16 minutes East 410 feet to beginning, containing 3,41 acres more or less. SECTION 3. It is ascertained and declared by the City Council of Little Rock that the City and the city property in said district rs in urgent and immediate need of the protection to life, health and property afforded by the levee and drainage works proposed to be constructed by the United States Government in the area described. It is therefore declared that an emergency exists; that such waiver is necessary for the immediate preservation of the public peace, health and safety; and that this Resolution shall take effect and be in force from and after its passage. • ADOPTED: October 13 , 1947.
