AN ORDINANCE VACATING, ABANDONING AND CLOSING
CERTAIN STREETS LOCATED WIT$IN THE COLISEUM URBAN
RENEWAL PROJECT, PROJECT NO. ARK R -17, IN THE
CITY OF LITTLE ROCK, ARKANSAS.
WHEREAS, a petition was duly filed by the Housing Authority
of the City of Little Rock, Arkansas, with the Board of Direc-
tors of the City of Little Rock, Arkansas, asking the Board of
Directors to vacate, abandon and close certain streets located
within the Coliseum Urban Renewal Project, Project No. ARK R -17,
same being more particularly described in said Petition and
hereafter; and
WHEREAS, after due notice, the Board of Directors has, at
the time and place mentioned in the Notice, heard all persons
desiring to be heard on the question and has ascertained that
said streets located within the Coliseum Urban Renewal Project
as more particularly described in said Petition and hereafter
are no longer needed or required for corporate purposes or for
use by the general public and adjoining owners in that other
streets are available and used for these purposes, and that the
public interest and welfare will not be adversly affected by
the abandonment thereof;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. That it is hereby ascertained and declared
that the use as public streets of the hereinafter described
streets located within the Coliseum Urban Renewal Project,
Project No. ARK R -17, are no longer necessary and needed by
adjoining landowners, the general public and for access to other

lands in the vicinity; that other streets and routes are
presently in existence or will be constructed pursuant to said
Urban Renewal Plan which reasonably, safely and adequately
serve the needs of adjoining landowners and thosaimembers of
the public traveling to and from the areas now or previously
served by said streets; that said streets are no longer required
for corporate purposes as public streets and should accordingly
be vacated, abandoned and closed, and all of the right, title,
and interest of the City of Little Rock, Arkansas, in the said
vacated portions of said streets should revert to the adjoining
landowners.
Section 2. That the City of Little Rock, Arkansas, under
its powers as set forth in Ark. Stats. 1947, § §19 -2304 and
19 -3029, hereby vacates, abandons and closes the following
described streets, and relinquishes, grants and conveys to the
adjoining landowners all of the right, title and interest of
the City of Little Rock, Arkansas, of its inhabitants, and the
public generally, in said streets,to -wit:
1. West 27th Street between Marshall Street and Wolfe Street.
2. Valliere Street between Battery and Wolfe Street.
3. West 26th Street between Schiller Street and Summit Street.
4. West 26th Street between Battery and Wolfe Streets.
5. West 26th Street between Summit Street and Battery Street.
6. West 31st Street between Marshall Street and Bishop Street.
7. West 33rd Street from Battery Street to the alley West
of Battery Street.
8. West 31st Street between Wolfe Street and Marshall Street.
9. West 30th Street between Summit Street and Schiller Street.

12. Marshall Street from West 34th Street to a point 150

The descriptions of the streets being vacated hereby are more
particularly described and shown in Plats and Exhibits attached
to the Petition of the Housing Authority of the City of Little
Rock, Arkansas, referred to above, which Plats and descriptions
are incorporated herein by reference.
Section 3. The closing and abandonment of said streets as
provided for herein, and the vesting of title thereto in the
adjoining landowners, one -half of each street to be vested in
the owner adjoining same, is specifically subject to the following
easement reservations:
1. Reservation of utility easements for all existing
utilities presently located within the street right -of -way;

2. Reservation of easements for installation of utilities
and site improvements to be installed by the Housing Authority
of the City of Little Rock, Arkansas, including easements
for storm drainage, water, sanitary sewer, gas, electric,
and telephone lines and facilities, as part of the site
improvement plan.for the Coliseum Urban Renewal Project,
Project No. ARK R -17, and the installation of other utilities,
including those listed above in this paragraph, by utility
concerns in concert with the Housing Authority of the City
of Little Rock, Arkansas, all in accordance with the Urban
Renewal Plan for said Project on file in the office of the
City Clerk of the City of Little Rock, Arkansas;
3. Reservation of the entire street right -of -way being
closed in these proceedings for a temporary construction ease-
ment during the installation of the site improvements under
the site improvement plan referred to in the preceding para-
graph, said temporary construction easements to automatically
terminate upon the completion of the site improvement work;
4. Reservation of easements for installation of presently
planned utilities to be instated by utility concerns subsequent
to installation of site improvements by Housing Authority of
the City of Little Rock, Arkansas, which presently planned
installations are as follows:
(a) Electric street light facilities in West 29th Street
from the alley East of Bishop Street to the alley West
of Bishop Street.
(b) Water distribution facilities for installation of a
24 -inch water main in West 26th Street between Schiller
Street and Summit Street.

(c) Water distribution facilities for installation of
a 24 -inch water main in West 26th Street between Summit
Street and Battery Street.
(d) Water distribution facilities for installation of
a 24 -inch water main in West 26tLh Street between Battery
Street and Wolfe Street.
Section 4. A copy of this Ordinance, duly certified by
the City Clerk, shall be filed in the office of the Recorder
of Pulaski County, Arkansas, and recorded in the Deed Records
of said County.
Section 5. The redevelopment of the lands now owned by
Petitioner, Housing Authority of the City of Little Rock, Arkansas,
and the installation of site improvements, as part of its Urban
Renewal Project, will be seriously delayed if said streets are
not closed and vacated immediately. An emergency is therefore
declared to exist, and this Ordinance, being necessary for the
immediate preservation of the public welfare, shall take effect
immediately upon its passage and approval.
Section 6. All ordinances, or parts of ordinances, in
conflict herewith are hereby repealed.
