1567 RESOLUTION NO. 1 6 . A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO AN AGREEMENT WITH THE OWNER OF BEELr,R'S ADDITION A REPLAT OF THE NORTH PART OF BLOCK 7 JONES & WORTHENS ADDITION TO THE CITY OF LITTLE ROCK, CLOSING THE EAST ALLEY IN SAID BLOCK, IN PURSUANCE TO SECTION 10032 OF POPE'S DIGEST OF THE STATUTES OF ARKANSAS. WHEREAS, the alley as originally platted in Block 7 of Jones & Worthens Addition to the City of Little Rock, Arkansas and being described as the strip of ground 16' wide and extending West from Woodrow Street into said Block 7 a distance of 184' and being more particularly described as beginning at the Northeast corner of said Block 7, running South along the East line of said Block a distance of 105' for a point of beginning, thence West 184', thence South 16', thence East 184' , thence North 16' to the point of beginning, has never been open to, nor used by, the public, nor is the use of such alley necessary for public travel; and WHEREAS, the said alley extended West from Woodrow Street a distance of 184' to a dead end; and WHEREAS, all of the ground surrounding said alley and being benefited by said alley was owned by a single property owner; and WHEREAS, the owner of said property has filed a replat, thereof said plat being of record in Pulaski County Plat Record Book #3, at page 169 and Bill of Assurance pertaining, thereto, being filed of record in Pulaski County Deed Record Book #246 at page 475, both of which instruments were filed April 14, 1937 in the Circuit Clerk' s office of Pulaski County, Arkansas and said replat providing a more adequate alley-way servicing said property and said alley having been dedi- cated to the public for its use as a public highway, free to all, as set forth in the above referred to Bill of Assurance; and WHEREAS, the property owner, who is desirous of having the alley first hereinabove described vacated; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The Mayor and City Clerk of. the City of Little Rock be, and they are hereby, authorized to enter into an agreement with the property owner of said Beeler' s Addition to Little Rock, Arkansas, providing for the vacation and abandonment of the East alley as originally platted in Block 7 of Jones & Worthens Addition as first herein described, except for that part, thereof, as dedicated to the public in the Bill of Assurance and plat attached thereto of Beelerts Addition, filed in the Pulaski County Circuit Clerkts office on April 1)4, 1937, said agreement to conform to the provisions of Section 10032 Pope's Digest of the Statutes of Arkansas, and to be recorded with the Circuit Clerk, as therein provided. Upon the execution and recording of said agreement, the alley in said block and as first described and set forth herein shall thereupon be vacated and abandoned. SECTION 2. This resolution shall be in force and effect after its passage. ADOPTED: March 31 , 1041. ATTEST: APPROVED: City Clerk.
