1557 RESOLUTION NO. a. 5 7. A RESOLUTION GIVING AND GRANTING UNTO THE MAYOR OF THE CITY OF LITTLE ROCK* WITH THE APPROVAL OF THE UTILITY COMMITTEE AND THE CITY COUNCIL, FULL POWER AND AUTHORITY TO TAKE ALL NECESSARY ACTION TO ACQUIRE THE PRESENT GAS DISTRIBUTION SYSTEM IN THE CITY OF LITTLE ROCK AND FOR FINANCING OF SUCH ACQUISITION. WHEREAS, it is the consensus of opinion of the City Council that the cost of gas distributed to the citizens of Little Rock is grossly excessive and it is believed that the Mayor should be given full power and authority, with the approval of the Utility Committee and the City Council, to acquire the present gas distribution system for the purpose of obtaining cheaper gas for distribution to consumers; and WHEREAS, the City is now authorized by law to acquire said exist- ing system and to pay therefor or finance the same in the manner provid- ed by law; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the Mayor of the City of Little Rock be and he is hereby authorized and empowered to take such steps as may be approved by the Utility Committee and the City Council to acquire the gas dis- tribution system within the City of Little Rock by purchase, condemna- tion, or in any other lawful manner, and all rights, easements and fran- chises relating thereto and necessary or convenient for the operation thereof as maybe deemed advisable and to make such agreements or take such steps as r3quired by law further necessary to fix a proper and reasonable price and terms for the payment thereof. SECTION 2. The Mayor and the Utility Committee, with the approval of the City Council, is hereby fully authorized and empowered. to make all arrangements and to enter into contracts for the employment, on a specified contingent basis, of engineers, certified public accountants, attorneys and other persons necessary to properly investigate and deter- mine all matters and things deemed necessary or advisable for determining the value of said plant and property and the desirability of purchasing same, the proper rates to be charged to the citizens for the gas to be furnished from said system after acquisition and to handle all legal .2. :ratters necessary in fixing said rates, the acquisition of said present gas system and its appurtenances and the financing of all said matters, it being understood, however, that all fees and expenses incur- red in the acquisition of said gas distribution system and all contracts therefor shall first be approved by the City Council before becoming binding upon the City. SECTION 3. That the contract of purchase and all other contracts and payment of fees shall be submitted to and approved by the Council before same shall become a valid and binding contract on the part of the City.
