1483 RESOLUTION NO. 1483 WHEREAS, the State Highway Commission of the State of Arkansas is desirous of improving Asher Avenue, in the City of Little Rock, Arkansas , by replacing the existing Viaduct and approaches, over Missouri Pacific Railroad and Chicago, Rock Island & Pacific Railway tracks , with a Viaduct and approaches thereto of modern design for carrying traffic into the city of Little Rock, thereby minimizing inconvenience and hazard to traffic, and WHEREAS, the State Highway Commission of the State of Arkansas is desirous of receiving Federal aid for the said improve- ment; and, WHEREAS, the Public Roads Administration, Federal Works Agency, will not participate in the reconstruction of said Viaduct until and unless the City of Little Rock will agree to refrain from permitting encroachments upon the right of way of said abovementioned route , and until and unless the City of Little Rock will agree to refrain from passing ordinances or laws fixing unreasonable speed limits on the said above mentioned route, and until and unless the City of Little Rock will agree to refrain from erecting signs, semaphores and signals that will give preference to local routes or that will hinder or delay traffic on said above route. THEREFORE, BE IT RESOLVED, by the Mayor and City Council of the City of Little Rock, Arkansas, that, for and in consideration of the State Highway Commission of the State of Arkansas and the Public Roads Administration, Federal Works Agency, reconstructing said Viaduct within the City of Little Rock and routing the traffic through the City of Little Rock over the said Viaduct on Asher Avenue it hereby agrees with the State Highway Commission of the State of Arkansas and the Public Roads Administration, Federal Works Agency, that it will not in the future permit encroachments upon the right of way of said above mentioned route, nor will it pass any ordinances or laws fixing unreasonable speed limits on the above mentioned route, nor will it allow the erection of signs, ^ r semaphores and signals that will give preference to local routes which intersect with said above mentioned route, nor that will slow up , hinder or delay traffic on said above mentioned route.
