1470 RESOLUTION r 14-70.
WHEREAS; The City Council did on June 12, 1939, pass
Ordinance #5745, commonly known as the garbage collection Ordi-
nance; and
IEREAS; petitions were filed seeking a referendum on
said Ordinance on July 11, 1939; and
HEREAS; Chancery Court , Pulaski County, aft,,r a
trial has ordered the City to conduct an election on the question
of c;hether or not said ordinance shall be continued; and
`.HEREAS; under the terms of amendment ;;F7 of the State
Constitution, electors of any municipality hive the right to
refer any measure passed by the City Council ;
-O,, THEREFORE BE IT RESOLVED BY THE MAYOR AND THE
CITY COUNCIL OF THE CITY OF LITTLE :ROCK, ARKANSAS, THAT :
A special general election is hereby ordered to be
conducted in all of the polling precincts in the City of Little
Rock, Arkansas, under the direction of the County Election Com-
mission as provided by law, between the hours of 8 A. M. and 6:30
P. IA. , on Tuesday, November 7„ 1939 ; and
The question to be presented upon the ballot shall be
upon the approval or rejection of said Ordinance X5745 . The bal-
lot shall contain the title of the said ordinance in full as
follows , to-wit :
"AN O.iDINANCE PROVIDING FOR THE COLLECTION OF GARBAGE,
WASTE, AND REFUSE IN THE CITY OF LITTLi ROCK; FIXING '
A SCHEDULE OF FEES FOR THIS SERVICE; PROVIDING FOR A
PENALTY FOR THE VIOLATION HEREOF; AND FOR OTHER PUR-
POSES"
together with the words :
"For Ordinance No . 5745
"Against Ordinance No . 5745
The Mayor is hereby authorized to cause to be publishe'
immediately a copy of this Resolution and further to deliver one
copy to the -sheriff of Pulaski County and one copy to the Jounty
Election •commission.
