1409 RESOLUTION NO. 1400
WHEREAS, There is now pending a project contemplating
the building of a levee surrounding the flooded district of Little
Rock; and,
WHEREAS, The United States Engineers have requested that
the City of Litte Rock furnish all easements and lands necessary
for a right-of-way for said levee; and,
WHEREAS, They have required that the City of Little
Rock must assume responsibility for all damages incident to the
execution of said project; and,
WHEREAS, The United States Engineers require that the
City of Little Rock must agree to take over operation and
maintenance of said levee when completed
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LITTLE
ROCK
SECTION 1. That the City of Little Rock furnish without
cost to the United States Government the necessary lands, easements,
and rights-of-way for a levee to be built around the flooded area
of Little Rock.
SECTION 2. That the City of Little Rock assume respon-
sibility for all damages incident to, caused by and/or growing out
of the building of said levee.
SECTION 3. That the City of Little Rock hereby agrees
to take over the operation and maintenance of said levee when and
after construction is completed in accordance with regulations
prescribed by the Secretary of War.
