1385 RESOLUTION NO. 13g5 7HEREAS, It is the policy of this City to promote safety in the driving of vehicles and to eliminate traffic hazards ; and, WHEREAS, There exists a serious traffic hazard at the point on " est 7th Street ;;here the :Missouri Pacific Railway and Rock Island Railway Company's tracks cross said street; and, .?HHEREAS, Said traffic hazard may oe eliminated by the construc- tion of an underpass at said location; and, `,WHEREAS, Said tract of land is owned by the Monarch Mill and Lumber Company; and, I WHEREAS, It is necessary to institute condemnation proceedings in order to acquire a right-of-way over the same ; and, ':'WHEREAS, Steps incident to such proceedings should be taken care of with the greatest dispatch; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK THAT the Mayor and the City Attorney are hereby directed and empowered to institute such condemnation proceedings as may be necessary in order to acquire the right-of-way over said tract of land, described more specifically as follows: Plot of ground bound on west by Jones Street , on north by lest 7th Street, on the east by the tracks and right- of-way of the Missouri Pacific Railway Company, and :rest 7th Street, on the south by a line running east and west 640 feet south of ;Jest 7th .Dtreet between Thayer and Jones Street, or so much thereof as may hereafter be found to be necessary to the accomplishment of said pro- ject. WHEREAS, There have been serious losses of life and property as a result of said traffic hazard; and, whereas, it would be for the benefit of the peace , health , safety and general welfare of the City of Little Rock that said underpass be immedidBly constructed; an emergency is hereby declared to exist and this resolution shall be in full force and effect from and after its passage.
