3549Of t OliDINANCE NO. 3549 An Ordinance to amend Ordinance No. 876, entitled, "An Ordinance granting a right of way over certain streets of the City of Little Rock, Arkansas, to the Little Rock Trac- tion and Electric Company, for the construction, operation and maintenance of a street railway system, and to grant to the Arkansas Central Power Coripany a right of way over Eleventh Street between Lew�a Street and Jackson Street, and on Jackson Street, between Eleventh Street and Eighth Street, and in the new City Park, in the City of Little Hock, and for other purposes." BE IT ORDAINrZD BY THE CI l"Y C O to I C I L OF THE CITY OF LIT`T'LE ROCK, ARKANSAS: Section 1. That for the purpose of constructing, maintaining and operating its street railway system, with the necessary side tracks, switches and turnouts on and along the streets hereinafter named, the City Council of the City of Little Rock, does hereby grant unto the Arkansas Central Power Company and its successors and assigns, upon the terms and conditions hereinafter set forth, for the period beginning at the date of the passage and acceptance of this ordinance and extending until the 27th day of September, 1951, the exclusive right to construct, maintain and operate its elec- tric street railway system of the overhead single trolley type on and along the following streets: A single or double track with all switches, curves and sidetracks and turnouts, on Eleventh Street from Lewis Street west to Jackson Street, and on Jackson Street from Eleventh Street north on the east side of Sackson Street as -2— it shall hereafter be laid out by hundred feet, to Eighth Street to City Part: and State Fair grounds; a tract of land within said City Beginning at a point on b the widening thereof three an entrance into the New thence a right of way over ask described as follows; the north line of West Eighth Street forty (40) feet west of the west line of tionroe Street extended north, thence north for a distance of 390 feet to a point; thence west 210 feet to a point; thence south parallel to the east side of Jackson Street extended for a distance of 315 feet; thence in a southeasterly direc- tion a distance of 90 feet, more or less, to a point on the north line of vilest Eighth :street; thence east 160 feet to the point of beginning, containing one and nine- tenths acres, more or less.; said Company being hereby granted the right to build its tracks with all necessary and proper loops, curves, stniitches and sidetracks within said Park. Section 2. This grant is made subject to all the terms and conditions of said Ordinance lNo. 876, and all amend- ments thereto, except as herein specifically modified.. Section 3. Said Arkansas Central Power Company shall be exempted for a period of **64mwn years from paving between its rails and two feet on the outside thereof, as required by said Ordinance No. 876, on Lewis Street from Thirteenth Street to Eleventh Street, and on Eleventh Street from Lewis Street to Jackson Street, and shall be exempted during the life of this grant or franchise from paving between its tracks and two feet on the outside thereof on Jackson Street from Eleventh Street to Eighth Street, and on the right of way within said Park described by metes and bounds in Section One hereof. -3- 4 Section 4. Said Company shall not be required to operate its cars regularly further than Eleventh and Monroe Streets; but shall operate its cars from Eleventh and Monroe Streets into said Park and around the loop therein on such occasions as justify 'and demand street railway service. Section 5. Said Company is hereby authorized and directed to discontinue operation of its cars over its tracks on Lewis Street between Eleventh Street and Eighth Street, and to take up and remove its said tracks, poles and wires; provided, however, it shall not be required to remove the dump or roadbed in said Lewis Street between Eleventh and Eighth Streets. Section 6. Said Company shall not be required to construct the tracks hereinabove provided for until the City b =rr of of Little Rock shall have establisP ednthe grade on Lewis Street, beginning at a point on the north property line of West Twelfth Street and the center line of Lewis. Otreet and the center line of `hest :eleventh Street, to be fixed at an elevation of 203.4; thence viest on 'Nest Eleventh Street a distance of 75 feet to an elevation of 202; thence west a distance of 201 feet to an elevation of 107, at a point on the east lire of Abigail Street and the M-1- -a- n center line of West Eleventh Street; thence wrest a distance of 389 feet to a point at the east lire of Peyton Street and the center line of idlest Eleventh Street to an elevation of 192.10; thence wrest a distance of 389 feet to a point on the east line of Washington Street and the center line of 4est Eleventh Street to an elevation of 185.5; thence west a dis- tance of 321 feet to an elevation of 180; thence west a dis- tance of 200 feet to an elevation of 180; thence wrest a dis- tance of 204 feet to a point at the intersection of the center lines of Jefferson and West Eleventh Streeta to an elevation of 182.5; thence vest a distance of 385 feet to a point on the west line of Lladi s on, and the center line of `molest Eleventh Street to an elevation of 188.3; thence west 100 feet to an elevation of 180,; thence wrest a distance of 250 feet to an elevation of 186 at a point on the wrest line of Conroe and the center line of Wiest Eleventh street; thence west a distance of 140 feet to an elevation of 184.3 at a point on the east line of alley between Monroe and Jackson streets and the center line of 'lest Eleventh Street; thence wriest 160 feet to a point on the east line of Jackson and the center of Jest r` r Eleventh Street to an elevation of 180 and- i�'r- e L leventh •a,tre�t...,to. the , rzac .eF. erg xiala ve- de'scrll' tto. All elevations herein fixed in this ordinance refer to the BENCH 1,MK on top of south nut at top of f ire hydrant of the assumed elevation of 206.82 feet, at the northeast corner of Lewis and Nest Twelfth Streets. Section 7. That all ordinances or parts of ordinances in conflict here..1th arc hereby repealed, and this, ordinance being for the immediate protection of the public peace, health and safety, and for the support and mainten- ance of the municipal government, and in the exercise of its public powers, an emergency is hereby declared, and this ordinance shall take effect and be in force aa a binding contract between the City of Little mock and the Arkansas Central Power Company, its successors and assigns, from and after its passage, and its acceptance by said Arkansas Central Power Company within 30 days from the date of its passage.
