That the zoning classification of the following described property be changed from PCD, Planned Commercial District, to Revised PCD: Lot 1 of the Appletree Subdivision, City of Little Rock, Pulaski County, Arkansas. Section 2. That the approval of Whole Foods Revised Short-Form PCD (Z- 5787 -C), located on the northeast corner of Chenal Parkway and Bowman Road, is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. • The allowed uses include book or stationary store, clothing store, drug store or pharmacy, furniture store, hobby shop, lawn and garden center (enclosed), office, office equipment and sales, food store and retail uses not listed (enclosed) within the C -3, General Commercial Zoning District. • The approved food store is limited to Whole Foods and not transferable to any other grocery user. • The hours of dumpster and compactor service are limited to 7:00 AM to 6:00 daily. The dumpster will be picked up three times per week with the samO -0 IF as above. The compactor will run no more than three (3) times per day. a A&W. ► c U CIO PAGE 1 OF 31 lH v 1 • The trucks on the site shall not leave their engines or other motors running while 2 waiting to make deliveries. 3 • The existing screening fence will remain in its current location and proper 4 maintenance will be performed to the fence replacing any damaged or missing 5 boards including the structural poles. 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 • Leland Cyprus or similar evergreen screening plants shall be planted starting at the rear of the loading dock area placed fifteen (15) feet on center and placed eight (8) feet from the loading dock wall and continuing to the front of the building. • All outdoor music and the use of the patio will end by 9:00 PM. Section 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. Section 4. That the change in zoning classification contemplated for Whole Foods Revised Short- Form PCD (Z- 5787 -C), located on the northeast corner of Chenal Parkway and Bowman Road, is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. Section 6. That this ordinance shall not take effect and be in full force until the final approval of the plan. Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
