Section 1. That the Board of Public Affairs be, and the
same is, hereby{ authorized and directed to enter into a lease
agreement with the Southern I,_aterial �° Construction Cozn,any for
the city property s iti Bated notth of the I issouri Pacific Cem-oany's
railroad tracks between the west and east lines of Ashley Street,
extenddd, for a term of years not longer than the duration of
the lease the said Company has on ad,jotnA;ng property, tend to
comely with terms as outlined in a letter now on f ile in the
City Clerk's office.
Section 2. the terms of the lease call for an improvement
of a storm sewer, which has been in an unsanitary condition and
for that reason an
a menace to public health, and emergency is hereby declared,
and this ordinance shall take effect from and after its passage.

This refers to the outfall storm sewer at foot of
Ashley Street.
For the past several years, you recall that complaints
have been made by various citizens regarding the unsightly and
unsanitary condition existing between the present outlet of this
sewer under the 1,Tissouri Pacific Railroad tracks and the er?ge of
the river bank, some 150 feet north. This condition is a menace
to the rublic health.
During the summer months, sewage stands in this ditch
continuously which is very objectionable, not only to the employees
of our company located in our office adjacent, but also to the
guests and others of the Marion Motel.
`r`le have had this matter up several tires vTi_th Mr.
Rice, City Engineer, also with the engineers of the FTissouri
Pacific Railway Company with a view of extending this sewer to
the water's edge and filling over the same, whihh would eliminate
this condition entirely and also do away with the unsightly ditch
just back of the Motel . 71e have always been advised that there are
no funds available to do this work.
le have a lease on your property from the west line of
Ashley Street, extended, to the east line of Snring Street, extend-
ed, which has a period of several years .yet to run and if you are
willing to add to our present leas, the property between the west
line of Ashle.;T Street and the east line of - °-shle y Street, which
would be made by building and filling over the said sewer eytensicn,
we will construct the sewer and pay for same and ta'.e credit upon

our lease rental for the amount of the cost of this improvement.
We estimate this cost will be approximately $4000.00,
however, all plans and details shall be approved by your City
Engineer �.nd zT reductions under this price shall be credited.
Furthermore, should we be able to get the 1- IT Pacific to
contribute something towards the construction of this sewer, either
in the way of labor and materials or in money, the value of this
also to be deducted from the �3ost to the City. In ether words,
we will construct this for actual cost to us and tai :e our payment
in credit on lease rental.
The bringing aboat of the improvement herein suggested
would add materially to a better appearance -of ti,e river front
and would be in like with ^e present movement to beautify this
portion of our city.
