118241 2 RESOLUTION NO. 11824 3 A RESOLUTION TO DECLARE A 120 -DAY MORATORIUM ON THE ISSUANCE 4 OF SIGN PERMITS FOR AREAS OF THE CITY BEING CONSIDERED FOR 5 DECLARATION AS SCENIC CORRIDORS; AND FOR OTHER PURPOSES. 7 WHEREAS, the Little Rock Planning Commission has under consideration the issue of 8 whether to declare four (4) areas of the City as a scenic corridor, and 9 WHEREAS, Little Rock, Ark., Rev. Code § 36 -530 includes the definition of a "scenic 10 corridor" as "a public right -of -way which, in the opinion of the board of directors, exhibits 11 special aesthetic and visual characteristics worthy of protection through enhanced billboard 12 regulation, and 13 WHEREAS, to avoid any conflict with the consideration of the four (4) proposed scenic 14 corridors and this definition it is necessary to place a moratorium on the issuance of any 15 sign permits until this discussion has been completed and a final decision has been 16 reached, 17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF 18 LITTLE ROCK, ARKANSAS: 19 Section 1. Immediately upon the adoption of this resolution there shall be in place a 20 prohibition for a period of one hundred and twenty (120) days on the issuance of billboard 21 permits along the following described areas: 22 (a) Stagecoach Road from Colonel Glenn Road to the county line; 23 (b) Kanis Road from 12th Street and Rodney Parham to the intersection with the 24 planning boundary of the City of Little Rock; 25 (c) Colonel Glenn Road from Stagecoach Road to the intersection with the planning 26 boundary of the City of Little Rock; and 27 (d) Chenal Parkway or Financial Center Parkway from 1 -630 to Kanis Road. 28 Section 2. Any billboard for which a permit has been issued prior to the adoption of this 29 resolution, and for which a lease or title to the property upon which the billboard is to be 30 erected is in place on the date of the adoption of this resolution, shall be permitted to be 31 erected during the period of this moratorium. This moratorium is imposed only because the City is in the process of holding 2 public hearings and further reviewing whether to impact the land use plans in place for the 3 areas set forth in Section 1 by the designation of one (1) or more scenic corridors and 4 wishes to maintain the current situation as it relates to billboards, and other outdoor 5 advertising in these areas while this public process is completed. 6 Section 4. While this moratorium is for a period of one hundred and twenty (120) days 7 from the adoption of this resolution, if this process is completed prior to that time and one 8 (1) or more of the areas listed in Section 1 are not designated as a scenic corridor, then this 9 resolution shall have not force and effect as to any such area. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution. Section 3. Repealer. All ordinances and resolutions, inconsistent with this resolution, are hereby repealed to the extent of such inconsistency.
