RESOLUTION NO. 13,663
3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO WORK
4 WITH CITY STAFF AND OUTSIDE CONSULANTS TO DEVELOP ALL
5 NECESSARY DOCUMENTS TO IMPLEMENT A NEW PENSION PLAN
6 FOR NON - UNIFORM EMPLOYEES; AND FOR OTHER PURPOSES.

8 WHEREAS, the Board of Directors recognizes the importance of ensuring that non - uniform City of
9 Little Rock employees are afforded an adequate retirement; and
10 WHEREAS, there has been legislation introduced in the past three (3) regular sessions of the
11 Arkansas General Assembly that would require non - uniform City employees to participate in the
12 Arkansas Public Employees Retirement System ( "APERS "); and
13 WHEREAS, participation in APERS by City employees would forfeit City control over the non -
14 uniform City employee retirement plan and have a significant impact on the City Budget; and
15 WHEREAS, there is concern that the current defined contribution plan that is in place for non -
16 uniform City employees, even when combined with Social Security benefits, is inadequate to meet the
17 retirement benefits needed for an adequate retirement; and
18 WHEREAS, studies reviewed by City Staff and an outside consultant retained by the Human
19 Resources Department pursuant to a request for qualifications process indicate that the most efficient
20 mechanism for providing adequate retirement benefits to non - uniform City employees is a defined benefit
21 plan; and
22 WHEREAS, one of the items that was discussed during the 2011 Sales Tax Campaign was improved
23 funding for the non- uniform employee pension plan.
24 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
25 OF LITTLE ROCK, ARKANSAS:
26 Section 1. The Board of Directors hereby authorizes the City Manager to work with the staff of the
27 Human Resources Department and the outside consultant to develop all documents necessary to
28 implement a new non - uniform pension plan that would take effect on January 1, 2014.
29 Section 2. Severabi/ity. In the event any title, section, paragraph, item, sentence, clause, phrase, or
30 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
31 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
32 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
33 resolution.

I Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
2 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
