136601 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 RESOLUTION NO. 13,660 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER INTO A CONTRACT WITH BUILDING AND UTILITY CONTRACTORS, INC., IN THE AMOUNT OF $616,200.00, TO REPAIR THE ARKANSAS RIVER TRAIL SLOPE FAILURE; AND FOR OTHER PURPOSES. WHEREAS, a portion of the Arkansas River Trail fell into the Arkansas River during the flood of 2009, and WHEREAS, the Federal Emergency Management Agency (FEMA) has established a maximum amount of funding it will provide to make the necessary repairs to the trail, and WHEREAS, the State of Arkansas will contribute 12.5 % of the cost to repair the trail, and WHEREAS the balance of the repair costs must be paid by the City of Little Rock, and WHEREAS, the trail is a popular venue for recreational trail users, and, WHEREAS, the Mayor's Bicycle Friendly Community Committee has expressed its support for proceeding with the repairs, and WHEREAS, five (5) bids to make the repairs to the trail were received, and WHEREAS, the lowest responsible and responsive bid was submitted by Building and Utility Contractors, Inc., in the amount of Six Hundred Sixteen Thousand, Two Hundred Dollars ($616,200.00). NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The Board of Directors hereby authorizes the City Manager to enter into a contract with Building and Utility Contractors, Inc., in the amount of Six Hundred Sixteen Thousand, Two Hundred Dollars ($616,200.00) in order to make the necessary repairs to the Arkansas River Trail. Section 2. Funding for this project is available as follows: $77,025.00: 2012 Grant Match Accounting Unit (AU) 108459 S45A108 $539,175: FEMA and State of Arkansas Grants AU 270129 G030143 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution.
