rin Ordinance Appropriating the Sum of aev'enty
Five Dollars to Pay the Claim of 11. JI..
O'Leary against the City of Little Rock.
Whereas, W. A. O'Leary filed hiS claim agsinst the City
of Little Rock for da�aages to- Lot 2, Block 6, 'Nest Rock Ad-
dition to the City of Little Rock, caused bjr the change of t
grade �iade for Street Improvement District Number 508, which
Improvement was constructed in 1931, and
Wn�:reas, under a writ of Mandamus from the Pulaski Oircuit
Court, the City was required to narae assessors to fix the dam-
ages caused by said change of grade, and
Whereas, said assessors' have fixed the da-mages due the
said W. A. O'Leary at ;x75.00,
Now Therefore,
Be it ordained by the City Council of the City of
Little Rock:
Section 1. The sum of Seventy five and no /100 (01"75.00)
is hereby appropriated to pay said d.a-.rage as fixed and reported
by said assessors and the Mayor and City are hereby di-
rected to issue the City's warrant therefor.
Section 2. All ordinances and parts of ordinances in con-
flict herewith are hereby repealed and th-Is ordinance shall be
in full force and effect from and after its passage.

Gentlemen:
Claimant, W. A. O'Leary, states that he is the
owner of lot two, block six of West Rock Addition to the City
of Little Rock, which lot is within the confines of Street
Improvement District #508 and faces the pavement upon, what
we believe Is, No. i4artin - just a block past Sherrill's
grocery; that for the. building of the pavement the City Couin-
oil changed the grade of the street in front of said lot by
raising said grade some four or five feet above the former
grade which was about on a .level with said lot and with ref -
3rence to which former grade said lot had long previously been
improved by the erection of a residence thereupon.
.Raising the grade of the front street caused the
said lot to be below the street to the extent the grade was
changed and causes it to overflow when it rains - always to
the extent of forcing the tenants to use a bridge from the
road or pavement to the porch of said house and when the rain
is heavy the water gores o-aer the floors of the house. This
condition exists as to all of West Rock Addition facing the
Cantrell Road pavement.
Damage has been to the extent of at least $1000.00
to the lot and improvements.
R. C. Butler is hereby named as the ovrriert s assessor
and the City is respectfully requested to name its assessor
within the statutory limit in order that the two so chosen may
name a third and the three then appraise the damage and make
the report required by law.
