5043Ordinance No. An Ordinance Appropriating the Sum of x3,05.15 to Pay the Claim of Nancy 14. Bivens Against the City of Little Rock, Whereas, Nancy M. Bivens firmed her claim against the City of Little Rock for damages to lots 2, 3 and 4, Block 7, West hock Addition to the City of Little Nock, Pulaski County, Arkansas caused by change of street grade made*for Street Improvement Listrict Number 5080 which improvement was made in 1931, and whereas, undar a writ of mandamus, from the Pulaski Circuit Court, the City was ordered to name assessors to fis the datrages caused by said change of grade and otherwise comply with the Statute of the State of Arkansas, and Whereas, said assessors have fixed the damages due the said Nancy Al. Bivens at x$390.00 and the costs adjudged against the Cit1 in said suit were -$5.1F and the said Nancy M. Bivens has agreed to accept said sum in full settlement of said Barrages, Now, Therefore, Be it ordained by the City Council of the City of Little Rock: Section 1. The sum of 430-5,15 is hereby appropriated to pay said damages and-costs and the Mayor and City Clerk are hereby authorized and directed to issue the city's warrant therefor payabae to the said IJancy M. Bivens or her attorney. Section 2. All ordinances and parts of ordinances in conflict herewith are hereby repealed and this ordinance shall be in full force and effect from and after its passage. �kpprove&- MAY 2 9 1933 1533.
