AGAINST ALL DAMAGE AND EXPENSE TO ADJACENT LANDOWNERS ACCOUNT
OF REBUILDING THE VIADUCT ACROSS EAST SIXTH STREET IN THE
CITY OF.LITTLE ROCK, ARu.ANSAS:'
BE IT ORDAINED BY THE CITY COUNCIL CF THE ! T71 OF ,T, T "°ELF R COCK ;
Section 1. In consideration of the Missouri pacific
Railroad Company at the request of the City of Little Rock
rebuilding in accordance with plans approved by the Mayor of
said city and now on file with the said engineer of the viaduct
which carries tracks of the Missouri Pacific Railroad Company
across East Sixth Street in said city, theCity of Little Rock
assumes and will pay and forever hold harmless the Missouri
Pacific Railroad Company from payment thereof of all damages
and expenses accruing to any and all lands'. jacent to said
viaduct on account of tj e rebuilding thereof and will hold the
Missouri Pacific Railroad Company harmless from any and all
claims of land ovaners against the Missouri Pacific Railroad
Company on account of the rebuilding of said viaduct,
Section 2: It is found that the existing viaduct
across East Sixth Street unnecessarily obstructs public travel
and is dangerous and that public safety requires its immediate
rebuilding Qnd an emergency is hereby declared and this ordinance
shall be in force from and after its passage.

RELEASE
KNOW ALL MEN BY THESE PRESENTS:
That for and in consideration of the sum of One Dollar
paid to me , r eceipt whereof is he reby acknowl edged, and of the
benefits expected from the improvement hereinafter described, I,
the undersigned, National Refining Cam any
being the owner of the following described lands in Pulaski County,
State of Arkansas, to wit
I
All of Block 31 - Garland's Addition to the City of
Little Rock
do hereby waive and release all claims or causes of action for
damages to the said land on account of the rebuilding by the
Missouri Pacific Railroad Company at the request of the City of
Little Rock,Arkansas of the viaduct across East Sixth Street ad-
jacent to said lands in accordance with plans agreed to by the
City of Little Rock,Arkansas, and in consideration thereof all
such claims or causes of action against the Missouri Pacific
Railroad Company or the City of Little Rock,Arkansas are hereby
waived and released.
This release is intended to cover damages as distin-
guished from
actual taking of
land,
and if in the rebuilding of
said viaduct
any part of said
land
is invaded and actually taken
this release does not waive or release compensation for any such
invasion and taking but claim therefor may be made according to
law notwithstanding this release,
