AN ORDINANCE PROVIDING FOR THE LEVYING OF A CHARITY TAX PROVIDING FOR
THE ASSESSMENT AND COLLECTION OF SAID TAX, AND FOR OTHER PURPOSES.
WHEREAS, There has arisen in the city of Little Rock an emergency
by virtue of the withdrawal from the city of Little Rock and the county
of Pulaski aid formerly given by the Federal Government to and for the
relief of the indigent poor and disabled of the City and County who are
unable to follow any gainful occupation; and,
WHEREAS, Many individuals and families throughout the City and
County are in desperate circumstances, destitute, and in many instances
are faced with starvation; and,
WHEREAS, A relief agency has been set up to work in cooperation
with representatives of the Mayor of the city of Little Rock, the mayor
of the city of North Little Rock, and the County Judge of Pulaski County,
authorized to receive funds from the respective agencies of Government
and also by public subscriptions in order to care for the indigent poor
and unemployables for whom the Federal Government will not be responsible;
and,
WHEREAS, The said relief agency known as the Pulaski County Welfare
Department has petitioned the council as follows:
After careful study of every available means of securing additional
revenue from the city, thus enabling it to assume its responsibility to
give relief to those citizens from whom Federal relief has now been with-
drawn, the Pulaski County Public Welfare Department respectfully petitions
the City Council at its regular meeting Monday, April 30, to pass an
ordinance affixing a 10�e charity tax to all statements rendered by the
four public utility Companies of Little Rock - - gas, water, telephone,
light, said statement of charity tax to appear on all monthly bills issued
by these corporations. This charity tax is asked for a period of one
year, ending May 1935.
During the interim it is the purpose of the Pulaski County Welfare
Department to arouse sufficient public opinion so that the Arkansas
Legislature meeting in January 1935, may pass legislation enabling cities
and counties in the state to assume their responsibility for their own
welfare program.
We are also petitioning the City Council of North Little Rocx to
take similar action at its next meeting; and,
WHEREAS, In view of the depleted condition of the treasury of the
City of Little Rock, Arkansas, it now becomes necessary to reach new
sources of income in order that the city of Little Rock may be able to
respond and meet this crisis; and,
WHEREAS, Revenues derived from this source probably would, if
properly supported, meet the required obligations of the Relief Agency
without a further appeal for private subscriptions; sz7's1, therefore
BE IT ORDAINED BY THE CITY COUP: . >1 l., OF THE CITY OF LITTLE ROCK,
ARKANSAS;
Section 1. What, for the purpose of meeting the obligation herein
placed upon the City, there is hereby levied a Charity Tax, of ten cents
(10,e�) per month per customer per public utility.
Section 2. That,the tax herein levied shall be added by each
public utility operating in the city of Little Rock adding to each
customer's bill each month 1&% m;g. the sum of ten cents (10¢) per customer,
and said amount shall be shown on the bills sent out by the respective
public utilities as "Charity Tax ". The respective utility companies shall
collect, without cost to the City of Little Rock, said tax and keep
accurate and proper records thereof and shall turn over the money so
collected at least once each month to the City Collector of the city of
Little Rock, Arkansas, taking his proper receipt therefor; or at such
other times as may be agreed upon by and between the said City Collector
and the proper representatives of the respective public utility companies.
Section 3. That, the said City Collector is hereby directed not
to mix funds so received with any funds belonging to or collected for the
City of Little Rock for any other purpose; and, further, the said City
Collector is authorized and directed to pay over to the duly authorized
agent for the Relief Committee, immediately upon receipt of any moneys
received from the said Charity Tax, and is further directed to take the
proper receipt therefor.
Section 4, The City hereby guarantees to relieve the said
public utility companies of any and all liability which might arise by
virtue of legalAction instituted by any taxpayer for recovery of the tax
paid by the said taxpayer. It is hereby expressly provided that the
collection of this tax shall continue in force for only twelve months
from the date of the passage and approval of the said ordinance.
Section 5. In view of the depleted condition of the finances of
the City and the dire need of many living in Little Rock, and the revenue
herein provided being necessary for the immediate relief of the distressed,
an emergency is hereby declared to exist and this ordinance shall be in full
force and effedt from and after its passage and approval. ' /
