ORDINANCE NO. 5138
AN ORDINANCE TO DECLARE CERTAIN ACTS A NUISANCE, AND
FOR OTHER PURPOSES
VMEREAS, numerous complaints have been made to the
Health Department of the City of Little Rock, regarding the
molesting, emptying and diffusion over the alleys, public
streets, vacant lots and other places in this City, of gar-
bage, rubbish, waste, and other contents of garbage cans; and,
WHEREAS, the health of the citizens of the City of
Little Rock is endangered by such practice;
Now therefore,
BE I'T ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE
ROCK, ARKANSAS
SECTION 1. The commission of any of the acts enum-
erated in Section # 2 shall be deemed a nuisance;
SECTION 2. (a) Emptying the contents of any garbage
can in any alley, public street, vacant lot, or any other place
not provided for such use;
(b) Uncovering, and leaving uncovered,
the contents of any garbage can located in this City, thereby
permitting flies to have access to same.
(c) Disturbing the contents of any gar-
bage can located within this City whether anything is taken
therefrom or not.
SECTION 3. Any person committing any of the acts,
enumerated in Section 2 hereof, and declared by Section 1 here-
of to be a nuisance, shall be deemed guilty of a misdemeanor
and upon conviction thereof, in the Little Rock Municipal Court,
shall be fined in any sum not less than $5.00, nor more than
$25.00
SECTION 4. In view of the unsanitary condition
caused by the above acts, and the danger to the public health
an emergency is hereby declared to exist and this Ordinance

shall be in full force and effect from and after its passage
and approval.
