5186yy ORDINANCE NO. 51,s6 AN ORDINANCE AUTHOLIZING THE 1MYOR AND BOARD OF PUBLIC AFFAIRS TO CONTRACT FOR AND SIGN A LEASE FOR CERTAIN PROPERTY, AND FOR OTHER. PURPOSES. 17HEREAS, the City has been offered a quantity of land on a year's lease, with an option to renew for yearly periods from year to year; and 1MEREAS, by leasing such property the City can secure from the Federal Government, and /or its Agencies, sufficient contributions to con- struct without cost to the City a park and a camping ground suitable for use as a transient camp; and WHEREAS, it is desirable that the said property, as herein- after described, be leased for park purposes and that some place removed from the business and residence district be secured where transients may be cared for: NOT' THEREFORE, BE IT ORDAINED by the City Council of the City of Little Rock, Arkansas: Section 1. That the Mayor and the Board of Public Affairs be anc they are hereby authorized to enter into a lease with Union 'Trust. Company, Trustee, and the Bank Commissioner of the State of Arkansas in charge of Union Trust Company for liquidation, for the lease of a certain tract of land known as the McCarthy -Fens tract and containing approximately 497 acres in Sections 14, 23 and 26, Township One North, Range 12 West, Pulaski County, for a rental of $1250.00 and the assiunption by the City and its agreement to pay all general and special taxes and assessments falling due and payable in the year 1935, not to exceed, however, in the aggregate the sum of $130.00; said lease shall be for one year and the rental shall be payable in one in- stallment on the Z5 h day of January, 1935. It being the purpose of this lease to provide additional park facilities and a suitable place for transients, the lease contract shall contain a provision giving the City the right to renew the same from year to year on the terms hereinabove set forth and set out in the lease contract, if it is found that the property is needed for the aforesaid pur ^oses; but no renewal lease shall bind the City for more than one year. The contract of lease shall contain a provision giving the City the right and option for nine (9) successive years to renew the same each year as it page 2 - Ordinance No.. expires for another year upon the same terms and conditions as those herein contained and to be set forth in the original lease contract, the method of e-erc_ sin.- said option to be as agreed upon and set forth therein. the lease contract shall also contain the provision that in the event the City exercises said rnewal option for nine successive vears and during said period duly performs its covenants as leases, including r,ayment of the rental each year and all taxes and soecial assessments as hereinabove set forth, the property shall at the expiration of the last lease period be deeded to the City without " further payments by the City. SEC'TILN Ordinance tJo. a 1 - )assed on the 26th day of W_Noveber 1934, is hereby expressly repealed and all other Ordinances and parts of Ordinances in conflict herewith a.re hereby expressly repealed. SECTIOIJ 3. The care and housing of transients in the City of Little Rock having reached great proportions and it being neces- sary to immediately make some provision for a slate where they may be cared for, an emergency is hereby declared to exist and this Or- dinance is found to be necessary for the immediate preservation of the public peace, health and safety and the same shall be in full force and effect fror.l and after its oassap-e and approval.
