5196ORDINANCE NO. 9196 AN ORDINANCE TO RELIEVE THE VARIOUS CONTRACTORS 7H0 ARE ERECTING THE UNIVERSITY OF ARKANSAS MEDICAL SCHOOL BUILDING FROM THE PAYMENT OF PERMITS AND INSPECTTION FEES. Passed.- January 14, 1935 Attest; City Clerk. Mayor. BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK; Section 1. The contractors who are nor engaged in the erection of the new building for the Medical School, University of Arkansas, at Thirteenth and LIcAlmont Streets, are hereby relieved and held free from the payment of any and all building permits and inspection fees in connection with the erection of said building, and City Engineer and City Plumbing Inspector are hereby specifically authorized and directed to furnish whatever certificates that may be r� required by the various agencies and individuals interested in the construction of said building, just as though and in the same manner as if the fees which would have been reauir ed except for the bassa.ge of this ordinance had actually been paid. KNOWLTON MAYOR ' January 17, 1935• To the Members of the City Council: I am returning with my veto Ordinance No. 5196, "AN ORDINANCE TO RELIEVE THE VARIOUS CONTRACTORS WHO ARE ERECTING THE UNIVERSI`1'Y OF ARKANSAS 1aEDICAL SCHOOL BUILDING FROG PAYMENT Or PERIaIT AND INSPECTION FEE'S," passed January 14, 1935. Miy reasons for this veto are: _ 1. -he architect and bidders/ were notified by letters and through the telephone that payment of permit fees would be required. 2. The specifications furnished various bidders provided: "That General Contractors shall obtain and pay for all permits required, all legal notices, and pay all fees required for the work except that permits, notices, deposits, fees, etc., specified under heating, plumbing, electric wiring, etc., shall be paid for as specified under these headings." 3. I have contacted local contractors who were unsuccessful bidders and every one of them says permit fees were included in the bids submitted. 4. The breaking down of the bids by the successful bidders was done in each instance after the award was made, and the f ailure to include the permit fees in the breaking down cannot be set up right- fully as a claim for non - payment of such fees at this time. The rebate of these fees, as I see it, means a donation to the contractors and not to the Medical School. If the Council wants to donate the amount of these fees to -2- Council- 1- 17 -35• HORACE A. KNOWLTON MAYOR Ya041W the Medical School at a later date for the equipment of its laboratory, or for some other purpose wnere the Medical School will get tae full benefit of it, I will certainly not Oppose such action. The bidders all had the same specifications, awards were made to those who submitted bids based on such specifications, and I am of the opinion that contract should be adhered to.
