5197ORDINANCE N0. 5197 AN ORDINANCE APPROVING AN AGREEMENT BETWEEN THE SECRETARY OF WAR AND THE CITY OF LITTLE ROCK IN REGARD TO THE LEASING OF THE AIRPORT; AUTHORIZING THE EXECUTION OF SAME ON THE PART OF THE CITY, AND FOR OTHER PURPOSES B2 IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS SECTION 1. That the Agreement between the Secretary of War, of the first part, and the City of Little Rock, of the second part, a copy of which is hereinafter set forth in full, be and the same is hereby in all respects approved: (an original copy of the said agreement consisting of two (2) rages of mimeograph copy is attached hereto and made a part hereof.) V, -2- a SECTION 2. That the Mayor of the said City be and he is here- by authorized and directed to execute such Agreement in duclicate on behalf of the City of Little Rock, and the Clerk of said City of Little Rock be and he is hereby authorized and directed to impress and affix the official seal of said City to each of said three copies of said Agreement and to attest such seal. SECTION 3. That said Clerk be and he is hereby authorized and directed forthwith to forward three copies of said Agreement, as exe- cuted on behalf of said City, to the Secretary of war of the United States of America, Washington, D. C. SECTION 4. That the said Clerk be and he is hereby authorized and directed to forthwith send to said Secretary of War, two certi- fied copies of the proceedings of the City Council in connection with the adoption of this Ordinance including; the Ordinance itself, and such other documents or proofs in connection with the approval and execution of said Agreement as may be required by said Secretary of War. SECTION 5. That whereas there are large numbers of unemployed in the City of Little Rock and considerable sums of money are being expended for the relief of such unemployed persons; wi'hereas the Agreement hereinabove set forth will result in the expenditure of funds by the United States of America in the eui- ployment of labor, thereby reducing the number of unemployed; Whereas the rapid development of air transportation without adequate flying facilities has greatly increased the dangers inci- dental thereto; whereas said Agreement will enable the City of Little Rock to obtain the use of a combination administrative building and air- plane hanger, thereby reducing the hazards incidental to air trans- portation; and Whereas it is necessary for the preservation of the -public -3- peace, health and safety that this Ordinance shall become effective without delay; an emergency is hereby declared to exist and this Ordinance shall go into immediate operation and shall become effec- tive from and after its passage and approval, Passed: January 28, 1935 Attest: Approved: City Clerk Mayor. T '• t P.W. 25220 AGREE:ENT dated as of 1935, by and between the SEC_` i0ff OF STAR, of the first part, and the CITE OF LITTLE ROCK, ARKAR,SAS, of the second part, modifying the lease (herein called the "Lease ") of property known as LITTLE ROCK AIR DEPOT executed by the party of the first part on December 30, 1931, and by the party of the second part on Decem- ber 28, 1931. TrEREAS, the party of the first part, by the Lease, let to t:e party of the second part property known as the Little Rock Air Depot, Arkansas, shorn on the blueprint or map attached to the Lease and :lade a part thereof, for a term of twenty --five (25) years from January 1, 1932, with the option of renewal by the party of the second part for an additional twenty --five (25) years, to w'nich Lease reference is hereby made for all and singular the covenants, terms, conditions, provisions and reservations thereof; and WIEREAS, the party of the second part rushes to construct, or cause to be constructed, on said property known as Little Rock Air Depot a combination hangar and administration building and the necessary facilities in connection therewith, and has in accordance therewith made application (P.W.A. Docket No. 2001) to the Federal Emergency Administrator of Public Forks (herein called the "Administrator") to include the construction of said improvement in the compre- hensive program of public works, to be prepared by him and to aid in the con- struction or financing thereof, all pursuant to Title II of the National Indus- trial Recovery Act, approved June 16, 1933 (48 Stat. 195); and WYEREAS, the Administrator has approved the construction of said im- provement on said premises all subject to the execution of a contract of con- struction and lease satisfactory to the Administrator, between_ the United States and the party of the second part; and WIiEREAS, the party of the first part approves the construction of said improvement and wishes to facilitate the construction thereof; and WHEREAS, the parties of the first and second part both desire to modi- fy the said Lease, to express their said intention and agreement, all as herein- after set forth: Docket No. 2001 w `.'...R P. W. 25220 NOW THEREFORE, IT IS NMUALLY AGREED AS FOLLOWS: FIRST: The party of the first part consents to and approves the con- struction of a combination hangar and administration building and the necessary facilities in connection therewith on the property known as the Little Rock: Air Depot, said improvement to be constructed by the United States acting by aad through the Administrator in a location and in accordance with plans and speci- fications to be approved in writing by the party of the first part, and in ac- cordance with a contract of construction and lease to be entered into by the party of the second part and the United States acting by and through the Administrator. PROVIDED, however, that said contract of construction and lease shall be confined to provisions relating to the construction and maintenance of said structure and to its use by the party of the second part, and shall not extend the term granted by the Lease, and provided, further, that the same shall have the written approval of the party of the first part endorsed thereon; and SECOND: The Lease is hereby modified to the extent and only to the extent necessary to permit the construction,maintenance and use of said im- provement as aforesaid, and except as so modified, all other covenants, terms, conditions, provisions and reservations of the Lease shall continue and remain in full force and effect.
