5241ORDINANCE NO. 5241 A111 ORDI'NA1vCE DECLARIN03 THE PURCF:ASING OF OLD GOLD AND OTHER PRECIOUS 12TALS TO BE A PRIVILEGE; FIXING A TAX THEREFOR; PROVIDING A PENALTY FOR VIOLATION OF THIS ORDINANCE; AND FOR OTiiMP PURPOSES BE IT ORDAINED BY THE CITY COUNCIL OF T:E CITY OF LITTLE ROCK, ARKANSAS SECTION 1. That from and after the passa,6e of this Ordinance the b,yirg, selling, trading and /or dealing in old gold, silver, latinum and other precious i metals is hereby declared to be a privilege and from and after the passage of this Ordinance each person buying, sellin5, trading and /or dealin, in all such metals shall be required to pay a privilege tax as stated in subsequent sections of this Ordinamc� . SECTION 2. All persons, firms or corporations doing such business within the City of Little Rock shall be req ired to pay an annual privilege license in the sum of Twenty -five Dollars ($25.00) for the privilege of buying, selling, trading and /or dealin_ in all such metals of any and all descriptions. Said priv- ilege tax shall be f or a period of one (1) year or a fraction thereof. SECTION 3. Each person buying, selling, trading and /or dealing in all sach metals who is doing said act or acts as the agent of some individual person, firm or corporation w',-Lich is doing business within the City of Little ' ock shall pay an annual privilege tax of Seven Dollars Fifty Cents (%7.50) per annum for the privilege of engaging in such. occu:ation. Said privilege tax to be for each year or fraction thereof. SECTION 4. All persons, firms or corporations covered by said Section 2 of this Ordinance shall be required to possess a proper United States license for such business. It shall be permissable for persons soliciting, buying, selling, trading and /or dealing in old gold as the agent of another, who has paid theannual privilege tag as provided in this Ordinance, to operate on the United States `ov- ernment license of his principal after said person has paid the annual privilege tax as provided he a in. SECTION 5. The City Collector of the City of Little Rock is hereby au- thorized to issue, according to the _rovisions of this ordinance, a license to every person making an application therefor, for the pur?,ose of soliciting, buy- ing, selling, trading and /or dealin° in all such metals upon the payment to said City Collector o; the sum as neieincefore stated in this ordin =nee . -2- SECTION o. Provided that this Ordinance shall not ay)ply to persons, firms or corporations who now pay a privilege tax for dealing in jewelry except that per- son, firm or corporation soliciting oldgold, silver, platinum and other precious (metals on behalf of, or as agents of, persons, firms or corporations having paid a privilege tax for dealing in jewelry shall be required to pay the annual tax as solicitors as provided in this ordinance. SECTION 7. Whereas there are numerous persons throughout the Cite of Little Rock soliciting, buying, selling, trading and/or dealing in old gold; and whereas some are legitimate and some are not; and, whereas it will be for the benefit of the peace, health and safety of the citizens of the City of Little Rock an emer- gency is hereby declared to exist and this Ordinance shall be in full force and leffect from and after its passage.
