5242ORDINANCE NO. 5242 AN ORDINANCE AMENDING ORD INA?v CE NO. 4865 APP ROVED JUNE 1, 1931; FIXING AN ANNUAL FRANCHISE TAX FOR CUTTINC CURBS IN THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES WHEREAS, MarW property owners and businesses have out curbs in the City of tle Rock fcr the purpose of aiding and expediting their business; and, +MREAS, Such practice is an added expense to the City of Little Rock in that additional police protection is required to prevent parking of automobiles contiguous to said curb line; and, WHEREAS, Additional expense and work is placed upon the garbage department of the City in keeping the streets and gutters contiguous to said curb line clean and policed; Now, Therefore, BE IT ORDAINED BY THE CITY CO MIL OF T :E CITY OF LITTLE ROCK, ARKANSAS SECTION 1. That Section 3 of Ordinance 4865 approved June 1, 1931 is here- by repealed. SECTION 2. For curb cuts now in existance or to be made in the future which shall exceed Fifteen (15) feet ;in length there shall be an annual franchise tax of Twenty -five Cents ($0.25) per running foot per year for each foot in addi- tion to the said Fifteen (15) feet. Provided, where a business is located upon a corner such business shall be allowed to Fifteen (15) feet on each street with- out the rayment of any tax. SECTION 3. The fee herein provided for shall be paid for annually in ad- vance to the City Collector of the City of Little ;Pock, Arkansas, beginning June 1, 1935. SECTION 4. In view of the derleted condition of the finances of the City necessitating curtailment in police, fire and health protection and the inability of the City to stand the natural expense necessary to the proper policing of curb cuts as herein provided an emergency is hereby declared to exist and this ordin- ance being necessary for the preservation of the public peace, health and safety and it shall be in full force and effect from and after its passage and approval.
